When an employee?s form I-9 information is different from records available to federal and state governments, it?s called a tentative nonconfirmation, otherwise known as a TNC. When this happens, E-Verify needs additional information before it can confirm employment authorization. Here?s how to process and refer a TNC. Once E-Verify recognizes a mismatch of records in your case, you?ll receive a further action notification. Click the download further action notice button. The further action notice will print and prepopulate in English by default. To print a prepopulated notice in Spanish, click the drop-down arrow and change the language. Once you printed the notice, review it for accuracy in private with the employee. Tell them they must indicate on the document whether they intend to take action to resolve it, or take no action, and then to sign and date the notice. The employee?s decision and signature should be captured on the English version of the printed further action notice. You must provide a copy of the signed notice to the employee. You?ll then attach the original signed notice to their form I-9 for your records. After your meeting with your employee, you?ll enter your employee?s decision in E-Verify. Select the option indicating whether the employee will take the action to resolve their TNC. We understand that in some instances, there is a user error. If you accidentally entered information incorrectly resulting in the TNC, select the option stating the information entered was not correct, and click close case. The case will instantly close as invalid due to incorrect data. Then, you may create a new case with the correct information. If you select the option indicating the employee will take action to resolve the case, it will be referred to the appropriate agency once you click continue. If you select the option indicating the employee will not take action, an alert will notify you the case will result in a final nonconfirmation, and ask if you are sure. Choosing to continue will update the employee?s case as a final nonconfirmation case within E-Verify. If you refer the case, select download referral date confirmation. After printing the notice, attach a copy to the employee?s form I-9 and then provide them with the original document. Once again, you?ll have the opportunity to print in either English or Spanish. Moving forward, you can periodically check the case in E-Verify to see if the status was updated. E-Verify, confirm employment authorization with confidence.
