[Music] hello and welcome back to Straight Talk earlier this week Praeger you known for its short educational videos posted a video featuring former US Senator Jim DeMint explaining how the states can save America he claimed this would be done by a convention of states under Article five of the Constitution Praeger you usually gets it right unfortunately this time they dropped the ball when considering that DeMint made false claims as well as some half-truths while illustrating big government as a giant robot DeMint asks quote so how do we cut this giant down to size is it even possible he claims the founding fathers in their wisdom knew the direction our government might take and that they put the article five convention in the Constitution in order to repair it but is that true was article 5 intended to cut big government the founders inserted the article five convention for correcting errors in the Constitution not for correcting the errors of politicians big difference the solution to big government is for the voters to enforce the Constitution by holding their elected officials accountable to their article six Opeth office let's get back to DeMint and his false claims he stated that at a convention each state would get one vote wait what where the Constitution doesn't state that article five only states how a convention can be called and that's by two-thirds of the states applying for the convention that's it it's then Congress that's that's the date time location in apportionment of the delegates for the convention in fact did you know that over the course of history Congress has proposed 41 separate pieces of legislation for the selection of delegates many of which based the apportionment of those delegates and votes on the electoral college that would mean that instead of one state one vote each state's vote would be based on their population so California would have 55 votes compared to Wyoming's three and finally the demesne half-truths regarding the late Supreme Court Justice Antonin Scalia DeMint neglected to point out that the polled quote came seven years prior to Scalia's nomination to the Supreme Court in the video DeMint implied that Scalia referred to a convention of states but Scalia actually used the term Constitutional Convention DeMint also left out Scalia's more recent thoughts on this subject when he actually was a Supreme Court justice on April 17 2014 during an appearance on an episode of the cab report Justice Scalia was asked if he could amend the Constitution in one way what would it be and why Scalia replied quote I certainly would not want a constitutional convention I mean whoa who knows what would come out of that Scalia spoke of a constitutional convention in the context of proposing amendments of the Constitution under Article five and he thoroughly rejected the idea highlighting his belief in the unpredictability of such a convention later in 2015 when Scalia was asked if a constitutional convention would be in the nation's interest he stated quote a constitutional convention is a horrible idea this is not a good century to write a Constitution convention of states project may try to convince you that a constitutional convention is not the same thing as a convention of states or that a convention is the only solution to big government don't be fooled my advice to you is do your own investigating and research we hope Prager you will do the same on this subject a great place to start is the John Birch Society stop a constitutional convention action project page at jbs org so until next time take care always and god bless [Music] [Applause]
