hi everyone Arnold rich from progressive legal we're talking about the trademark process today and when would it be appropriate to seek consent from another trademark owner to coexist on the trademark register it does happen sometimes when there's just no way through the trademark process that you can get through and get some protection without getting consent from another trademark owner which IP Australia feels is just too close for comfort and more often than not we would advise it's the last resort to go and approach another trademark owner for their consent the reason for that is a few there's a there's a few reasons for one is that it puts the other trademark owner on notice that you're applying for a trademark so potentially they could oppose the trademark application which would stifle you know stifle the application and then add to further costs a second thing is they may even worse still try and stop you from using the trademark and it could be a business name it could be a derivative product name or a byline tagline it could be something you put a lot of emotion energy and cost and expense into building only to be told to stop using it so business want a business owners worst nightmares so it's a really really tricky one to and and case-by-case basis you have to really consider whether or not you approach another trademark owner that's on the register already and work out whether or not they're going to be ok with coexisting and really it's it's you know you yep you are you're playing it as it comes and seeing we know whether or not these this other trademark owner will in fact let you coexist in many circumstances it's not an issue it's just you have to be aware that those are the risks but in most circumstances another trademark owner as long as they're not as long as you're not competing with each other there isn't any reason why they shouldn't you can't make them consent to it that's the that's the big problem with it the other or the other issue is that they may ask for their legal fees to be paid in the process which is probably only fair I hope that's answered some questions today about that part of the process of the trademarking if you want to send me some more information my emails in a progressive legal.com today you or go to the website Thanks
