okay so with respect to a separation agreement best practice is to go to your pre-trial conference with a separation agreement if you can it's not always realistic but Carlos can speak a little bit about the actual mechanics of putting together a separation agreement and what you need to make sure you are keeping in mind on your checklist so separation agreements are the goal right you don't want to go to trial nobody wants to do that exercise go through that exercise so at the time when it becomes appropriate you might want to draft the separation agreement just to have one handy in case that you are getting close to a settlement and in case that you can just hammer out the details and present one and sometimes we'll even in lieu of a settlement offer that's in a letter farm or bullet points we'll just draft a separation agreement and send it over and say this is our clients position feel free to make revisions that reflect yours and we'll go from there that just gets the dialogue going and I'll tell you right now I usually prefer to be the one drafting the first pass at the separation agreement because there's some anchoring bias there it helps cement some things you're singing off of your own song sheet so I often tell my client even if it you're gonna pay me for a few hours of work for drafting a separation agreement that maybe maybe you'll get some marginal value out of it because you you you get some benefit of having established something along your terms first and then it just becomes a little more more of a to-do to try to revise it and you know sometimes unfortunately you let the other side draft it and it's just an agreement that's not up to your standard it's not up to your client standards maybe has some real issues and I I've had a couple of it's happened to me a couple of times where the agreement that came over from the other side was just so poor that I had to just rewrite it completely from scratch because and then that creates other issues because the other side feels like a just through there's a way it creates contention but it would have been more work to revise something that was just not going to be useful than to just say you know what it's gonna be easier just to start from my own from my own drafting and send it right back and if I could just send it is amazing how far it will go once that separation agreement is drafted and comprehensive litigation is expensive it's exhausting it's very easy to take one position when you're sort of in the beginning of it or you're just you're showing up in court but when there's an agreement in front of you ready to be signed particularly if you have it with...
