this is Nathan with my nanny contract calm thank you for joining us in this video we address the question what is a termination provision in an any contract so to begin let's pull up an actual nanny contract this one is available on our website but if you have your own nanny contract we can provide you some advice at least in terms of what to know about a termination provision and what to look for so as with most contracts termination provisions are usually found at the end of the contract so flip to the last page of yours or scroll down as I'm doing here and you'll see here we are number 17 actually titled termination the termination simply means ending your contract and because a nanny contract is a type of employment agreement it means ending the nanny's employment with the family now if you don't have a nanny contract it should be noted that most states treat nannies as at-will employees by default now that means that the parents essentially have the right to fire their nanny for any reason or for no reason on the spot that means not giving the nanny any notice there's a couple exceptions it can't be an illegal firing for example letting the nanny go on the basis of race but generally they can let the nanny go on the spot if you have a nanny contract on the other hand the parents actually have to follow what the nanny contract says about letting the nanny go and likewise the nanny also has to follow that if she wants she or he wants to end their employment now here we actually have a few different provisions the first one is trial period our contract has a trial period of employment which lets the nanny try on the family and the family see if the nanny is a good fit now if the nanny wants to end employment then or if the family wants to let the nanny go because they just realize that things aren't working out we have that they have to give the nanny at least one days prior notice and the nanny has to give the family at least seven days prior notice and that can be changed based on the preferences of the family of the nanny next we have what we call a regular period and this is basically it could also be entitled termination without cause now termination usually falls into together categories it's either for cause or without cause and without cause means that the family doesn't have a reason basically that they need to end the contract that very day it means that they've kind of planned things in advance they know something's coming down the road and that they need to end the nanny's employment for example maybe one of the parents was transferred out of state for their work or maybe the children have reached school age and the nanny services are no longer reason when that case as we say here we say that family man the nannies employment for any reason by giving him or her at least four weeks prior notice likewise nanny may discontinue his or her employment for any reason by giving at least four weeks prior notice now these figures can be changed I think the industry standard is usually about three weeks but of course if the parents or than any like a different period they're more than welcome to change that or address it in their nanny contract now the next one is termination for cause and this basically means that there is a cause or a reason that the contract needs to be ended right away or at least it allows the option of ending the contract right away now here we say family may immediately terminate the nanny's employment for cause if the nanny and we actually list out things that might happen for example if the nanny violates the contract the nanny allows the children's safety to be compromised then Annie fails to perform his or her job duties then analyze are dishonest lies or is dishonest or steals the nannies convicted of a crime or if the nanny uses illegal drugs now I do recommend that if you do have a for cause termination provision and you should have one make sure that you actually lay out what specific things would allow for termination for cause otherwise if you simply say that the nanny can be terminated for cause period it's too open-ended and chances are you'll get into a dispute about what that means so for that reason it's best to as I said lay out specific things like allowing the children's safety to be compromised now that pretty much sums up what a termination provision is some useful advice is that if and when the contract does need to be ended be sure that you read it early in the process and follow what it says so dust it off take it out of your desk drawer read through it and if it says that you need to give four weeks prior notice make sure that you do that and usually you should do it by in writing where you actually write the other persons of your nanny write a letter to the family saying that one month from now or four weeks from now whatever is required I'm going to be ending my employment and this letter services notice of that fact likewise if you're a family you should do the same thing and usually because the relationship is such a close one you could have both a letter and a sit-down conversation where you meet and discuss the reasons for why the nanny contract will be ending that's usually best and then the written letter is just kind of follow-up documentation about the fact that notice was given so that wraps up our video on termination if you have any questions please visit our website at my nanny contract calm and I wish you luck with your nanny care
