[MUSIC] In Arizona, you're not required to file a probate if your estate only involves personal property, bank accounts, or vehicles with a collective total value of under $75,000. So if you have a $5,000 bank account, the courts nor the legislature want you to have to do a full-blown probate. 30 days after death, small bank accounts, personal property, collections... coin collections, or anything... car titles, cars, can be collected by an affidavit without having to file probate. If you have a vehicle, the Motor Vehicle Division has their own affidavit of collection of personal property. You can go to Motor Vehicle and fill out that affidavit and they will, uh, sign the car over to the heirs without having to go through the probate process. The $75,000 is collective, so if you have assets in one bank account for $50,000 and another one for 30 and a car, you would have to file probate. But, for instance, with a $50,000 account and a $20,000 vehicle you do not have to file a probate. The person that's entitled to those assets can collect that account by an affidavit of collection of personal property. It's A.R.S. 14-3971. This statute allows the rightful heirs to collect assets in small estates without having to go through the probate process.
