this is immigration attorney parvies malacouti and towards the end of last year 2019 uscis started making the i-130 petition for alien relative available online so this petition whereas previously it can only be filed on paper now it can be found online it's been about a year now we've had an opportunity to kind of take a look at the system see what the kinks are in the system and so forth and what issues arise one issue one question that i see pop up all the time is from people who are filing an i-130 themselves meaning not being represented by an attorney and at the end of introducing all of their biographical information and uploading the documents that are requested at the end of the process the uscis system asks you if you would like to upload additional extra documents to support your application so people have asked me on social media do i have to submit documents to this request should i submit documents to this request it's a good question and i'm going to talk about it right now so what are they talking about what is usas talking about when they say do you want to submit extra documents usually it's extra documents to support the relationship between the petitioner and the beneficiary to prove that that relationship is real and that it exists so as a general matter if you want to you could upload documents that show your relationship by showing for example if you're married to the beneficiary if it's a marriage-based petition you could show pictures from the wedding pictures of the couple the petitioner beneficiary you could upload evidence of communication between the two if you guys were separate let's say one was living in one city one was living in another city those are some of the things that you can upload there to support the application to support the petition excuse me now as a general matter in all of the i-130s that i've submitted this year for my clients i have not submitted any additional documentation i've only submitted the documentation that has been requested and so far all of these i-130s have been approved so as a general rule my preference is to not include additional documentation submitting to uscis if it's not asked for now that's a general rule of thumb that doesn't mean that i would take that track in all cases if i have a case coming up let's say for example where the evidence of the relationship between the petitioner and the beneficiary is weak if i think it's something that uscis might challenge then yeah maybe i would go ahead maybe we would go ahead and start submitting additional documentation so obviously everybody's situation is different it's a case-by-case situation i will say if you are filing an i-130 petition for alien relative online hopefully you're going to at least get a consultation if not be represented by a lawyer...
