a couple of them uh if you get any value out of this don't forget to smash that subscribe button all right so our first question here today is from samantha it says i watched your video on the landlord requirement to give notice to their tenant to enter the property for things such as work orders maintenance etc and i'm going to put a link to that video right here it says is text message considered a written notice as required under the statute so many tenants really love this idea of being notified by text and as i said in the in the uh the video when i covered this topic and by the way this comes from nebraska revised statute 76 14 23 no it doesn't unless the tenant and the landlord have agreed on alternative means of notification so let me clarify that if you don't have anything in your lease agreement that states how uh how these notices are supposed to be delivered then it's automatically assumed under the law that you're going to default to the statute which requires written notice which is a piece of paper and it's delivered in accordance with or served in accordance with the nebraska landlord-tenant statute however what a lot because you're right a lot of tenants love the fact that they just get noticed by text message and currently right now there are a lot of property managers that do deliver those type of notices via email or text message so the point is put it in your lease agreement it's really that simple and make sure that the lease agreement i mean objectively states or outlines the method of delivery if it's text that's what you're going to do now here is a key point though you can agree to it in writing and you can agree to it in your your lease agreement but you're going to have to figure out a way that you can print those text messages or somehow put them in some type of uh cloud file or something so if you need to use them in front of a judge or to provide a court uh you can print those and provide them that's where a lot of times landlords and managers screw up i know a lot of the property management companies have software that does it automatically and then the you know what databases those things etc but if you don't have that capability or that software you need to figure out a way and there are apps out there that'll do this for you uh you need to figure out a way where you can print or store those text messages so you can then provide them as proof should you need them if you have to go in front of a judge so yes you can but just put it in your lease and clearly outline what your lease is intended
