What are the most popular sales and marketing tools used by hot SaaS companies?
Well, I cannot speak for other SaaS companies, but we are in the space and we consider ourselves to be fairly hot so I’ll just tell you about some stuff we use.SalesflareYes, we use our own product. Salesflare is a sales CRM aimed at automating most of the sales flow. It automatically fills out our address book with data it pulls from sources like social media, company databases and email signatures. It keeps track of interactions of leads towards us (phone, email, calendar), including email and website tracking. All of that is automated in a nice timeline so we have all the information we need at our fingertips at all times. From the data it collects it will tell and remind you what to do about specific leads. It’s not a robot yet, but it does do most of the working and thinking for us.There’s a desktop and a mobile app, but I mostly use it straight from my Gmail, where it gives me everything I need on a customer from an integrated sidebar. You can grab a free trial from the website http://salesflare.comLinkedIn Sales NavigatorAt $79,99 a month (a little less when you take if for a year) it’s not exactly the cheapest tool from this list, however it’s a great source of lead generation for us. Sales Navigator features a wide arrange of useful filters that allow you to effectively search for potential clients. It offers analytics, insights and recommendations so you can stay updated and focus on the right people. We automate this lead generation process with Dux-Soup, which is a Chrome-plugin that acts as robot you can issue to visit LinkedIn profiles and collect its data. Just set your filters to target your ideal customers and tell Dux-Soup to go visit the whole list. Not only will you have all kinds of useful data on them, it will also you on their profiles that you visited them, which counts for visibility already. You can export this data in .CSV lists and then go nuts on these, for which we also use some tools (see below).Hunter.ioPreviously EmailHunter, this is a great tool to help you find email addresses. We give first and last names plus their company domains of leads we scraped from LinkedIn with Dux-Soup to Hunter and it gives us their email addresses back. It won’t find everything, return rate is about 70% but that’s a long way already.Rapportive One of my other favourite Chrome plugins. Rapportive acts as a sidebar in your Gmail and shows you LinkedIn profiles associated with the email address you have an email open from or are typing one to. It’s a great way to find out email addresses Hunter wasn’t able to give you. Just start typing some reasonable guesses in a draft email and whenever a LinekdIn profile pops up in Rapportive, you’ll know it’s the right one.I don’t currently use Rapportive anymore as Salesflare does the same, but if you don’t need a full-fledged CRM, this is solid, free alternative.Kimono LabsYou can use Dux-Soup for LinkedIn, but the web has more useful data to offer beyond LinkedIn. Kimono is the best data scraper out there, in our experience. Or was. Since it was bought by Palantir last year, the service has been discontinued. It used to work via a Chrome plugin connected to their server, but that server is not among us anymore and the plugin has been removed from the Play Store. There’s a workaround though. You can install the Kimono desktop app, which will act as a server. The Chrome plugin you can download here. On the house ;).If you’re looking for an alternative, you can check out Import.io, which is not as good though.MailChimpWe use MailChimp for email campaigns. Obvious choice, it allows for effective email campaigns that won’t end up in your recipient’s spam box. Other than that: powerful analytics, email tracking, great resources on email templates and easy to integrate with our other tools.MixMaxMixMax is the tool to turbocharge your Gmail. We use it alongside MailChimp because it sends emails from your Gmail and not from the MailChimp server. This makes it better for personal emails, as they won’t end up in the ‘Promotions’ tab of your recipient’s Gmail account. It also gives you more power in setting up email sequences; it allows you for example to break off a sequence when a recipient has responded to your first email. Other than that, it’s filled with cool features to spice up emails: slash commands, email templates, email and click tracking, embedded surveys/polls and an awesome meeting scheduler.AhrefsYou can use Ahrefs for organic traffic research. It will show you the backlinks (including URL and domain rating, as well as data of the link and other stuff) of every website out there, which makes it great to dig into the SEO strategy of your competitors. It also features a keyword explorer, which can be a great in helping you to determine the keywords you should be targeting. When you’ve identified your keywords, Ahrefs’ rank tracking tool can give you day-to-day updates on your ranking for your keywords.Another great tool for SEO is definitely Moz.com. It also features a keyword explorer, keyword rank tracker, web explorer to find link building opportunities and several tools to improve the SEO of your website.Google AnalyticsNo-brainer. Everyone uses it.Hemingway App Hemingway App will analyse a piece of text and grade it on readability. It does so by taking into account stuff like complex sentences, use of adverbs, use of passive voice and common spelling errors. Very useful to make sure your text is easy on the eye and suited for publication.ZapierLast but for sure not least. Pretty much the holy grail of sales, marketing and project management tools because it can make them all work together. You can pretty much pick out your favourite tool for every job and then tell Zapier to streamline them into an effective suite that is perfect for your business. Workflow automation done right.

How does one create a business plan?
Startups 101: How to Create a Business PlanThe first thing you need to do is create an executive summary and a mission statement. After that, you need to study your market, compare yourself to your competition, create a share structure, outline financials, and fill out the rest of the pertinent data like the other people suggest.Below is an example of the last executive summary and mission statement that I created for a company I was planning to launch earlier this year.Since I own the company, wrote this from scratch, and decided that I will not be launching this product, I decided to share. (Yes, it is heavily focused on marketing, but that's my primary expertise, if I'm even somewhat good at it... Who in the world knows...)I worked with a Product CEO and operated as the COO at this company and recruited a highly talented team, however the Product CEO decided to part ways so we scrapped the business. Also, you may not want to make a public benefit company unless you already have investors you can turn to for sure who don't care what kind of business you own. If you are seeking to raise money from venture capital, then it is highly unlikely that they will invest into your model. 1.0 EXECUTIVE SUMMARYCompany Name | Tagline | An American Public Benefit Company Founded in February of 2013, (“SE”) features contemporary women’s fashions specializing in comfort, fit and sexiness, established by a diverse group of individuals, led by the C.E.O. Ms. Lee. SE holds idealistic aspirations of giving back to the underprivileged, creates American Jobs and gives back to the community, while keeping the clientele engaged through social interactions SE provides: • A Philanthropic Vision. • Patriotism. • Quality Clothing. • Best Styles for women of the 21st Century. • Quality Content. • An Interactive Community. SE’s innovative design and marketing team constructs visionary product campaigns and strategies, designed to push SE to the forefront of the industry. Derived from the fictional character, Sophia Serrano, from the film Open Your Eyes, SE’s inspiration is characterized by Sophia’s radiant qualities of being: positive, down-to earth, original, mysterious, sexy, and guileless in a perfect world. Sophia is the “ideal” woman because not only is she divine in nature, she is able to cope through the greatest obstacles that obstruct her from her path. Simultaneously, Sophia is so unique, she makes a man follow her into the afterlife of his dreams. Not only did she (tagline) in the real world, she left him in need of her in the afterlife. SE wants other fashion brands and the world to know that everyone in this world matters, no matter your race, ethnicity, financial background or country of origin. SE empowers people to make a difference by: • Helping the Underprivileged Children of America. • Creating American Jobs. • Providing a more Eco-Friendly environment. All of SE’s products are made in the United States, providing more opportunities to influence economic growth. SE ensures no usable fabric goes to waste by collecting all the scraps of fabrics and donating the items to (charity), with the sole intent to create exclusive items, blankets, or articles of clothing for the less fortunate. In addition, SE donates 10% of all sales to (charity) , to help feed, clothe, and provide shelter for the less fortunate.SE plans to take a creative approach to branding and marketing the company. Not only will SE use traditional methods of marketing, such as mailing clothes to celebrities, look books to bloggers and editors, buying editorial spots, sponsoring events, and advertising online, SE will take grass root efforts to the next level in attracting hits to the website, along with social media to keep the clientele engaged. Sending celebrities, fashion editors and bloggers free gifts never guarantees the promotion of an item, so SE has decided to implement a revenue sharing program with its clothing. Each individual influencer will have a personalized URL to direct their clients to SE’s website. Each purchase made within thirty days by the referral of an “influencer” will generate an earnings check of $25 to the referrer. Checks will be cut once the accumulated balance signNowes $300, or can be exchanged to store credit. SE will seek out make up artists, photographers, stylists, and other professionals within the fashion industry to provide an opportunity to earn an extra source of income through its revenue sharing program. SE will also provide clothing to stylists, to have featured in editorial along with video content. SE’s grassroots efforts will take place in the form of carefully selected event sponsorships. Through event sponsorships, models will be showcased wearing the SE product through a trade booth. SE will take pictures of celebrities who try on the products and feature blog posts through social media efforts of the celebrities, while distributing the highly sought out images to fashion bloggers. SE will then pass out $10 SE Clothing Branded Gift Cards to people who fit the role of the target consumer of the brand at the event. Initially, 50,000 gift cards will be made for distribution within the first year, of which we expect at least 25,000 to visit the website URL. SE will implement a referral based program, where if a friend is referred to purchase an item through the SE website through their email or social media link within 30 days, the customer will have the choice to have one of the following occur: • $25 will be credited to the referrer’s account for Future Purchases. • $25 will be donated to the referrer’s Charity of Choice. The referee will also receive $10 credited off their first purchase. Studies indicate that 1 out of every 3 customers will refer their friends to a site that they trust and enjoy. SE will partner with publishers and affiliates such as Google Affiliate, Commission Junction, Avantlink, Affiliate Window, Webgains, Pepperjam, Integrate, Etc. to allow professionals to earn a profit by referring their clientele to purchase items from SE. In order to create better organic SEO (Search Engine Optimization) results to guide more online traffic to the website, SE will carry lines of both popular name brand and up-and-coming American Made products by other designers, such as Nasty Gal, Diesel, Ralph Lauren, Armani, Etc. In order to acquire the product necessary, SE will create a strategic partnership with its manufacturer to sell their excess inventory. Once new customers visit the SE site, they will be given an opportunity to register on the site to claim their $10 credit. Through registration, information such as the customer’s name, email address, phone number, address, and social media profiles will be gathered. Once the customer registers, they will be able to access the site. A welcome email will be sent to the customer within one day, welcoming them to the site. Within 5-7 business days, a letter stating SE’s appreciation of the customer with an outline of the brand’s philanthropic vision will be physically mailed to the customer on company letterhead and hand signed by the C.E.O., Ms. Lee. The customer will then be emailed, informing them that their gift card will expire in 30 days, 3 weeks, 15 days, 7 days, 3 days, 2 days, and a final offer email. This cycle will repeat for another 30 days for a total of 60 days, which will trigger a sense of urgency within purchasing an item within the allotted timeframe. SE will engage with customers by providing the first few sentences of educational content through email, while providing links to the blogging section of the website to read the full article, along with social media efforts on Pinterest, Facebook, Twitter, DeviantART, Tumblr, Google+, Polyvore, Wanelo, Quora, Lyst, Etc. to build trust with the clientele, and keep them engaged with the brand. SE will track user activity through analytic services provided by Kissmetrics to measure which campaigns work best, to better understand our audience. SE will influence increases in transaction sizes by donating one item to charity for every $300 spent in a single transaction. Not only would revenues increase, the philanthropic vision would accelerate to creating a bigger influence to society, which in turn will create a better image for the brand. SE will have a section on the site where users can upload images of their new purchases, how they pair their outfits, provide feedback to others, and like other consumer’s styles, creating an engaged society of buyers who become advocates and prosumers of the brand. SE will begin sales on the retail website, then slowly trickle into many online boutique stores, physical boutique stores, then into major department stores. Since bulk purchases from vendors decrease manufacturing costs, the business model is extremely scalable. As SE becomes a more established brand, price increases will be implemented in 10% increments per season, increasing profit margins while manufacturing costs decrease. SE will create separate databases for consumers who have at least purchased one item and another database for loyal consumers. In regard to the database of consumers who have purchased, collateral material providing a promo code for a promotional discount will physically be mailed to the clients two weeks prior to an anniversary or holiday sale, to provide exclusive access to the promotion. SE will randomly select users from the loyal consumer database to provide a free gift with purchase, expedited or free shipping, and various other promotional tools to reward brand loyalty. Once SE establishes a loyal client base, verticals will be integrated one product at a time in minimal quantities, initially to test the market to see how well the product does. Verticals will range from products such as cosmetics, shoes, handbags, hats, stockings, scarves, jewelry, and other womenswear based products. Led by C.E.O. Ms. Lee, SE has hand selected a managerial team of 8 creative unique individuals to grasp a portion of the $500+ billion dollar market by creating quality content, negotiating with vendors, managing finances, and laying out the long term growth of the company, all while creating beautiful product. 10 years from now, in the year 2023, SE plans to be acquired by LVMH, PPR, Richemont, Valentino Fashion Group, The Aeffe Group, Puig, Diesel, Phillips-Van Huesen, Hermes, Liz Claiborne, Inditex, The Arcadia Group, or Aurora Fashion for a strike price of $300 million. SE is currently seeking seed financing in the amount of $275,000 to be used to cover manufacturing, marketing, legal and operational expenses to establish the brand. MISSION STATEMENTUnited together, SE’s commitments to society are as follows:#1. To Mother Earth:We vow to make sure that no usable fabric is wasted. All usable scrap material will be recycled into specialty items, blankets or created into articles of clothing for the less fortunate.#2. To Our Nation:We vow to Shop American. What does "e-sign" mean?
E-sign is the abbreviation of the electronic sign, which is commonly used today for signatories to agree on a contract in digital form. Signatories can sign a contract on their mobile devices or PC remotely, and they don’t even need to meet. I worked for an e-sign platform start-up, so I have answered many questions from our customers like “Is e-sign act legal?”, “Why do we e-sign?” or “What’s e-sign’s pros and cons?”So, all the following information can be found and verified through the internet, and I just gather all the information for question askers. Is E-sign legally binding? The answer is Yes. Uniform Electronic Transactions Act (UETA) has been adopted by 47 states. The rest three states, Illinois, New York, and Washington have implemented their own regulation of the ESIGN Act. Therefore, it is commonly known that e-signatures and electric records are legally binding under the terms of this legislation. However, simply putting two name symbols on a document online does not make it legal. As UETA suggests, electronic signature processes should consider:- Authentication / Consent / Intent to be bound / Attribution / Security / Record Retention and so on.Why do we use e-sign?I was an international student, and I used to experience the hassle of the inconvenient in-person signing process. We used to spend a lot of time on making an appointment being there and signing, and if the one of ours wasn’t there, we will have to arrange another day to sign a leasing contract. However, e-sign allows us to sign most of the contracts at home. We just need to turn on our computer and use certain e-sign platform sending others the document which needs to be signed. Many industries have applied e-sign as a tool because that mailing an important contract is time-consuming, and it costs more money than sending a digital document. The sales team, real estate, and insurance have commonly applied e-sign platforms. E-sign platforms are like “witnesses”, helping signatories finish the signing process, but none of them would take responsibility for contract fraud or bsignNow.Pros:- Saves time & costs less money for delivery- Reduces sale cycles- Environment-friendly, paperless- Easy to store, won’t be damaged or lost.Cons:Since digital files are easy to be changed, and e-sign is not face-to-face signing action, many industries are still conservative about e-sign. For example, some lawyers said: people who want to bsignNow a contract would claim that it’s not him putting the digital signature on the contract. Because it is remote, there is no direct evidence to prove he is lying. Therefore, if you want to sign an important contract, please do not use the e-sign platforms that have no ID verification procedure. You will get a chance to be fraud.- E-signature fraud (denying/bsignNowing)P.SI am not a professional writer, but I am willing to answer questions that I know. Existing e-sign platforms are good, but they still have many potential flaws. Since I work in the industry, I know many e-sign platforms do not provide strong legal binding service or law support. E-signature is a new format of evidence, and it needs more development to fulfill rigorous scenarios, and to prevent e-sign fraud or bsignNow. If you have further questions, don’t hesitate to ask me.

What are the benefits of electronic signature?
What is Digital Signature? And Benefits of Digital Signature CertificatesA digital signature is basically a way to ensure that an electronic document (e-mail, spreadsheet, text file, etc.) is authentic. Authentic means that you know who created the document and you know that it has not been altered in any way since that person created it.Digital signatures rely on certain types of encryption to ensure authentication. Encryption is the process of taking all the data that one computer is sending to another and encoding it into a form that only the other computer will be able to decode. Authen...

I'm looking to expose APIs to 3rd party developers. What tools will help me protect my data and my company from an Equifax style
I am answering this question with the assumption that your data is at least as important or more important than the leaked Equifax data. This is based on my years in high security environments ranging from DoD contracting to competitive intelligence and entertainment media. If this data isn’t that sensitive, you may find my recommendations extreme. When building a world-facing API, how do you prevent an Equifax data leak?A lot of this is going to be architectural. That is, your code should be built in a way that provides some security as a natural byproduct of its design. It’s hard to specify what tools you should use - because the main tool is your head. If it was as simple as installing a special firewall or using Ruby on Rails, Equifax probably wouldn’t be having this problem. (Although maybe they would - I talk about this below).I’m alarmed by the tendency for many developers, sysadmins, and many companies to rely on firewalls, VPN (or forbidding VPN), requiring frequent and complex password resets - all this “last mile” security - with little or no attention to their actual software infrastructure.Secure the Data ItselfSo first, you have to figure out where your data is right now. Is that location “safe” in a general sense? Is it on a physically or electronically vulnerable server? Are you running the latest security patches? It’s not ok to be running some version of MySql server from 2009, on some long-abandoned version of Debian. That might seem ok if it’s sitting internally in your company and air-gapped from the outside world and still doing what you want it to. But it’s not ok.Create an Access FrameworkNext, you have to build the framework that’s going to expose this data. This is not the client-facing API. This is the framework that understands the database, understands where the database lives, what data can be acquired from it, and how to go about doing that. There should be policies implemented in code that determine things like rate limits (how many requests any particular “client” can make), what sorts of data, or what breadth of data, will be provided. These can be configurable, they can be adjustable depending on client, but they should be implemented at this level. This layer should provide absolute assurance that it is passing every single incoming parameter through a function that sanitizes it for processing. This is where we can make sure that we’re safe from SQL injection or similar hacks. This is where we can establish additional rulesets to prohibit certain types of request being sent down the pipe. This framework runs on a machine that is not accessible directly from the internet or which at the very least has a ruleset that limits it from responding to any but a preconfigured set of IP address. It is also the only machine which can communicate with the outside world in any way and also has line-of-sight to the database itself. Other systems should not be able to do this. Worker personal laptops, employee workstations with internet access, none of these should be able to see the database server AND the outside world if you’re worried about this data being leaked.Authenticate itIndividual queries into this framework should include authentication data - basically a cryptographically signed query from the outside server, proving the authenticity of the request.Scalability? If you need scalability and you’re set on making this cloud-based, then you’re going to want to code this exactly the way I’ve described, except you’re going to perform a lot of additional authentication. Everything’s going to be locked to acceptable IP addresses and/or cryptographic signatures. Now - we could talk more about the overall architecture of this framework - but we can say that it needs to “not be crappy - I don’t know that there’s any point in including a detailed break down here of what that means except to say that it should have a comprehensible system of data flow. Developers should understand where the data comes in, how it moves through the system, how it is transformed into a usable format and where it goes to be used. This shouldn’t be some indecipherable black box of code, one Class with a thousand methods, or worse: just a thousand functions. Different things happen to data, and the structure of your code should reflect the different things. Retrieving data from the database should be a specific region in your code - it shouldn’t happen everywhere, all the time. This allows you to make global changes and improvements by going to the areas in your code known to provide the particular service.ReportingAdditionally, this framework should be reporting information about its behavior to another database. It should be reporting the type of queries it’s receiving, what authentication data they’re connected with, success or failure states, etc.You have to do this because if you’re not, there’s a good chance you won’t notice the intrusion unless the database server overheats or somebody starts sharing your client lists on pastebin.World-Facing APIThen you have the world-facing API. If this isn’t a human UI, it’s probably a REST API or something similar. This API lives on a webserver, somewhere. It is able to connect with the access framework server directly, though its own known IP address, and that access framework server is able to reject requests that come from an unfamiliar IP address. It handles all of the initial authentication, and forms structured queries to the access framework. It’s not making raw SQL queries or anything, it’s messaging with the access framework itself. Each authorized user has a private key known only to them - and that key is used to sign their queries. Those queries, then, are validated and repackaged by the code behind your REST API and additionally signed by that code when they are sent down the pipe to your access framework. Your *internal* keys should be updated frequently and automatically - and any unsigned or improperly signed queries should be immediately rejected and the associated account suspended. (It may be helpful to pass the IP address of the requester down to the Access Framework - that way, when malfeasance happens like this, you can automatically block the IP address as well until the issue is resolved.)Requests to this API should probably also be made only from known, registered IP addresses. It’s simple enough to detect the IP address of an incoming user - so configuring this should be easy for any of your clients. If they want to bypass this - perhaps the data is useful to their sales teams and they’ll be running a custom app that the individual salepeople travel around with on their laptops - then insist on 2FA. Otherwise, insist that they set up their own relay server that their sales apps connect to - and that one is the one you’re authenticating.AnalyticsLastly, you want an analytics front-end. This analytics front-end is monitoring direct database activity as well as the activities of the access framework. (Might even be monitoring connection info from your world-facing API.) You want to be able to glance at a panel and see spikes. You might want to be able to see where those spikes are coming from, both geographically and in your code. If larger queries, with more results, are being sent out - you want to know this. If Mozambique is suddenly interested in your data, you want to know this. And you don’t want to know this by looking at a log, you want to know this because you were looking at a Slemma dashboard or similar (I’m not affiliated with Slemma, but they do make nice analytics dashboards.)Unless the Equifax hackers had compromised thousands of Equifax *client* accounts, and spread their activities smoothly and evenly across all of them, slowly increasing their activity as the hack continued, it seems like any basic attempt at security analytics would have captured this long before a hundred million plus identities were leaked. What went wrong at Equifax?Equifax’s problem is substantial - and it’s built on some sort of bloated, Old World financial company nonsense. There’s a great Forbes article[1] that interviews a few security researchers about them. There’s evidence that Equifax uses really limitless amounts of old code - ancient frameworks, front-end code that hasn’t been touched or even read by a human in years. They’re using WebSphere, Apache Struts, Java - there’s a reference to freaking Netscape in the source for their sign-in page for godsakes. Has nobody even looked at their sign-in page source in the last nine years? XSS vulnerabilities as recently as last year…If I were to rank the most vital pieces of sensitive data in order of importance, it would go like this:National Security / Defense / Intelligence / NuclearFinancial (banking, credit, etc)Corporate financialNon-financial corporate intelligenceMedicalSo the last piece of advice, really, is: Don’t be a chump. Don’t feed sensitive data through a badly maintained, ancient pipeline that no-one can possibly vouch for the security of.The credit reporting world is a nightmare - made up of weakest link, followed by weakest link.Footnotes[1] A Brief History Of Equifax Security Fails

What does an information technology lawyer do?
That is not a term I have see used in real life.I offer the following from HG.org on Information Technology Law:What is Information Technology Law?Information technology law provides the legal framework for collecting, storing, and disseminating electronic information in the global marketplace. Attorneys practicing in this area of the law represent individuals and businesses from all different industries. They help structure information technology transactions in a way that maximizes the client’s economic benefit while ensuring regulatory compliance. A great deal of emphasis is also placed on anticipating potential sources of dispute between the parties to a transaction, and crafting agreements that address these concerns, thereby reducing the risk of litigation. When disputes arise in the field of information technology that cannot be resolved outside of the court system, a lawyer specializing in these types of cases can prove a powerful advocate compared to a general legal practitioner. Information technology law firms tend to hire lawyers with practical experience working in the industry prior to entering the legal profession. With such a background, a lawyer is more effective at explaining technical concepts to a judge or jury, and he or she will likely have contacts within the industry that make finding consultants and expert witnesses less difficult. Clearly, information technology law is a niche practice. Those looking to hire an attorney should bear this in mind.Software Licensing IssuesBusinesses often change or update their operating software in an effort to keep pace with technology. Switching software programs can lead to greater profitability, but it can also present any number of legal pitfalls for unsuspecting business managers. For example, a typical software licensing contract will contain provisions relating to performance warranties, installation and troubleshooting, user training, limited liability and indemnification of the vendor, infringement disclaimers, payment and finance terms, and more. Despite the complexity of these agreements, some software company representatives purposefully wait to provide a copy until shortly before the sale closes.Owners and managers who find themselves presented with a licensing agreement that they do not completely understand should resist pressure from the sales representative to sign the document with little or no time for meaningful review. Any “deadline” imposed by the vendor is likely nothing more than a high pressure sales tactic. There is simply too much at stake in the event the software fails to meet the needs of the business. The wisest course of action is to demand additional time, and hire an information technology attorney to analyze the contract and to point out terms that should be negotiated.Data Privacy and SecurityMuch of the litigation that occurs in the field of information technology results from enterprises failing to keep customer and employee information secure. Now that it is primarily stored in digital format, sensitive information is susceptible to theft on a scale unimaginable in previous generations. Hackers and other cyber criminals routinely target financial institutions, e-commerce websites, and ordinary businesses, sometimes gaining access to thousands of customers’ data all at once. This can lead to various legal claims, from government enforcement actions to class action consumer lawsuits.Companies that have any presence on the internet should act proactively to avoid these problems. Information technology lawyers are available to audit security systems and policies, and to recommend any necessary changes. If a bsignNow has already occurred, an experienced legal team can represent companies in investigations by the FTC or state attorneys general, and defend against civil litigation brought by private parties. Data privacy and security issues can arise at any time. To succeed in today’s business environment, it is critical to stay ahead of the curve and make safeguarding digital information a priority.Electronic Signature LawsAnother growing area of concern for many businesses involves electronic signatures. Like digital storage, electronic signature software has the potential to dramatically streamline operations for businesses willing to embrace new technology. At the same time, care must be taken to avoid compromising sensitive customer data and/or violating government regulations on the subject. With respect to electronic signature laws, business owners should be aware of at least the following two pieces of legislation: the Uniform Electronic Transactions Act (UETA), and the Electronic Signatures in Global and National Commerce Act (ESIGN).Nearly every state has adopted UETA in some form, while ESIGN was passed at the federal level. Together, these laws allow companies to replace traditional paper signature documents with electronic forms. Customers can agree to contractual terms with the click of a computer mouse, speeding up the turnaround time for a transaction considerably. However, UETA and ESIGN require businesses that use electronic signatures to comply with rules relating to customer consent disclosures, record retention, and document reproduction capabilities. Again, engaging an attorney to conduct a compliance review in this area is highly recommended.
