very serious nursing focused video today we will be discussing the things to watch out for and your nursing employment contracts [Music] anyways before we do start I'd like to impart a few things to you guys and discuss a few things that I actually learned while I was here and you know meeting up and talking to other nurses so today in the age of social media Google and the internet it should be easier to choose the right type of Nursing climate agency right now early at times it can get more confusing than ever so any rational nurse or rational person before signing up would use every resource available to them because this isn't like the olden days where the nurses of the past have nowhere to turn to and all they ended up doing was just ask around you know and ask around people who didn't know any better anyway back when it was basically a little bit more cutthroat and nurses just wanted to go no matter what even if the working conditions sucked as long as they set foot in the US and then work around it later on that's not necessarily the case today and it shouldn't have to be so going back you've got all the resource at your fingertips you've got Google you've got the internet you've got Facebook groups you've got YouTube you've got people like me so normally a rational nurse would research everything about that nurse employment agency starting with what is this agency has it gone through name changes how many nurses has it successfully deployed to other countries how does that agency do their processing of their documents what does the nurse have to pay who's running that agency is it based in the US or in the Philippines does it have basis in other countries like Dubai or United Arab Emirates or whatever did the other nurses complain about it or were they happy about how that agency did everything for them also a rational nurse would also Google the reputation of the person who's running that agency yes that's really important but in case you know you weren't able to do that or the rational nurse wasn't able to do that and that rational nurse ended up utilizing the services of the nursing employment agency who later on turned out not to have the best interests of the nurse at heart then what is the nurse to do because you can still you know back out of it and the right moment to do that is before signing any contract now let's define the term contract contract as the binding agreement between two people or two parties or a person and a party with nurse employment agencies it's not just any contract it's a contract that carries financial consequences and these financial consequences could make or break your career in the United States of America when that being said was nursing employment agencies you don't just sign like one set of contracts or one set of sheets of paper you end up signing anywhere between two to four because the first contract you'll ever sign will be between the nurse and the nurse employment agency and then between the nurse and the employer or the petitioner and then between the nurse and the landlady because of course it is the duty of the agency to find the appropriate housing and then for between the nurse and the car leasing company now this one you don't encounter often but there are nursing Clement agencies who claim that the moment you step out of the plane you must have a car waiting for you otherwise you'll die or you won't survive I mean I'm not saying you don't need a car in the US of 8 you do but that doesn't mean you sign up for car loans and you know pay exorbitant ways to get a car in the US even with zero credit history once you've passed your driver's exam you can rent a car you can buy a car secondhand and then you know just look for insurance I mean the possibilities are endless you don't need to be trapped in a four year long contract or a five year long contract paying exorbitant fees because that's just ridiculous I know a lot of you guys are married with kids some of you guys are single moms you don't need to waste your money that way now that being said another thing I'd like to import with you is before you sign your contract read the fine print and if you can get in touch with any nurse that's been deployed by the same agency to the same state to the same employer have her read your contract and see if your contracts are the same also have your contract be examined by an immigration lawyer particularly a lawyer specializing in philippi owners immigrants there are many out there willing to do pro bono work because trust me there are some employers to like take advantage yes they are I mean there are employers that will take advantage I'm not doing a makeup tutorial but I just apply my blush this way so anyways yes there tell if everything that your agency just told you was just lip service or if the terms of the contract will hold true and this has happened to some of the nurses I know that when they got to the US the employers changed the terms of the contract I kid you not and for a while they were helpless but they were able to find help later on a lot of you know or rather a lot of immigration lawyers that specialize in Filipino nurse immigrants they're willing to do it pro bono you can find them in Google and Facebook or through friends through friends of friends but make sure you've got one even before you enter the US and also having one safeguard see from exploitation because let's face it there are still some employers that like to exploit nurses you know they they give her a hundred patients to handle and only give her like I don't know forty five cents of an N will increase yes it has happened I have known several nurses have been through that they were quite helpless for a bit same of the h-1b visas but anyway I think it'll hold us same for us or for all nurses in general so the first thing you must watch out for and your nursing contracts are the definition of terms who are you in the contract because sometimes they call you the nurse to staff nurse whatever but most often more often than not I've encountered them calling you the HCP the healthcare professional now another thing mr. chairman is the agency who is the agency what is agency and the agency is more often than not the nurse employment agency third is your employer obviously which represents the hospital the nursing home or whatever it is you'll be working in the fourth is your petitioner at times your ploys your petitioner and other times it's the agency that's not necessarily a bad thing and then of course you must determine what's these for what they play in the contracts so you don't just read the contract once you read them over and over and over until it comes to a point that you have memorized the terms of the contract another thing to watch out for in your nursing employment contracts is the salary on your job offer make sure and I say this tiny time again make sure it is within the minimum prevailing wage rate for BSN RNs depending on state and area because there are some nursing agencies will tell you oh you don't need to worry if it's below the minimum prevailing wage tree okay Lenya and modest opinion but then when you get to the US they'll increase your rate anyway that's the easy to evaluate Gunilla not true so what know what pay money new I love when there's employment agencies say that not true some states will do that but do you really want to risk it this is why the US Embassy in the Philippines has been very vigilant if they check your job offer you know during your interview and then they you know they determined that it's not within the minimum prevailing wage rate that is allotted for that state and that area they will put you on a two to one G visa status now when the u.s. embassy puts you in a two to one g visa status because of minimum prevailing wage rate that means your employer must send an updated job offer so to avoid all of that before you guys even get your interview send your agency and email or maybe even send them for an email I don't know who it is you're talking to and let them know the minimum prevailing wage rate for that state an area has already updated and ergo your job offer should be updated there's no shame in that you don't need to be harsh you do need to sound professional and decent and then they should be able to send you a new job offer within the next two to three weeks now another thing you need to watch out in your contracts would be your times off like how its accrued your PTO your sick days your bereavement leaves your holidays and holiday pay and your overtime pay because in some states you lucky you they don't just do time and a half they do times two and and some states what they do is they negotiate for example if they're asked me to come in on the weekend and you know you tell them that you have something else to tend to and the pay isn't big enough anyway because the overtime pay is not big enough for you then they only go shape again you lucky you that does exist it's just a matter of how to say it right and what right words to use now it being said do be vigilant when it comes to your PTO s because sometimes they get careless and we know you've already like you know you should have already accrued more than hundred hours because of all the overtime you've done and yet for some reason your PTO just reflects 90 or 80 what's that also the vigilant about medical leaves bereavement leaves jury duties as well as FMLA you'll learn more when you get here but these are just some things that you should be vigilant about when you're reading your contracts are studying your contracts another thing to watch out for in your contract is if your current employer will allow you to work in other hospitals or other nursing homes you know on your days off some agencies of course you know they stipulate in their contract that you are allowed to work elsewhere provided your employer and will give you an express written consent which for me is that it's just it's just st upid why do you need that let's face it a lot of Filipino nurses moonlight they work to hospitals you've got one who does a hospital and one home health you've got one who works in hospital and the other who works at a nursing home because if for example you've got a family of five unless you're in California it's really wrong to say that your salary will suffice for all your needs because trust me a lot of newbie nurses there and lots of loans they're in huge piles of debt and don't get mad at me I'm not saying this to to judge but really you really do need to take out huge loans just to get to the US and you need to pay those loans off so you need all the help you can get also there are other contracts that will say that if they find out that the Filipino nurse immigrant or the HCP the health care professional is working as a nurse in another area like you know somewhere like I don't know you're working the hospital and you you went across the nursing home across the street and you also work there on your days off then other contracts they stipulate that that's a breach of contract and it will cost you to get fired which again SST PID but it's some of the things that you need to watch out for another is there are some contracts that will state that you are allowed to work other jobs just not nursing jobs please there's a runaround that you can work online but I'm just saying it's something to watch out for especially if it's one of the conditions that they state as a breach of contract we will get there all right time to get controversial another thing and it's one of the most important things to watch out for in your contract is the breach Clause what is a breach basically a breach is not following your contract in the simplest terms and it could be a breach from the employer side or a breach from the nurse's side now in the contract they will stipulate what constitutes the breach one I've already mentioned previously which is working for other employers and there are others the thing is a breach isn't necessarily a bad thing it can be a good thing especially if you have an abusive employer now the thing about reach classes is you must have a breach cost with the agency and with the hospital unless it's one of those contracts where after three months you're no longer in contract with the agency you're already in contract with your employer you must also take note of the breach fees because some of them will say minimum $15,000 to maximum 25 or minimum of 25 to maximum $60,000 blah blah blah and then there's a fight print about additional damages find on the nurse so that's one of the things you need to take care of also and again this is a very controversial topic if you're still in contract with your agency and your employer or go both your agency and your employer must have a breach clause why because if you're still under contract with your agency and your employer should things go down south meaning should things not work out well your agency is still obligated to find another employer for you especially if it's been proven that you've had an abusive employer or you ended up suffering psychological damages because your coworkers blah blah blah yes that has happened trust me I mean you should hear the horror stories but going back if you're still under contract with your agency and your employee should have a breach fee stipulated for both because if not it's one of those shady sketchy situations that a lot of nurses end up in were they breach and they've paid the breach fee to the agency and then la er the hospital that they breached from chases them files the case and USCIS and tried to get there EB 3 status revoked you don't want that to happen to you I don't want that to happen to you but for more cases like these I do refer you to the previous video that I posted the one about an intro to Filipino RNs and us contracts we won't this more about breaches in the future but for now we need to move forward the next thing to watch out for in nursing contracts is housing sometimes the agencies will provide you with one month free house day and that includes a one month advance one month deposit and then later on three months later they'll ask you to pay them back that deposit other times they provide you with free house saying other times they're able to find housing for you where you only pay the rent and the rent is inclusive of all utilities case in point me my employer was able to find a nice apartment for me it's a one-bedroom apartment and it's 407 five dollars per month that's my rent and it's inclusive of all utilities except Internet and this is already me in my small town in North Dakota and other cities you pay 18 to 25 dollars per month for a one-bedroom apartment inclusive of all utilities and Internet and I know for a fact that in other states that's not the case so whenever you find housing that is inclusive all utilities well you lucky you again that's one of the things you need to watch out for in your contracts another thing you need to watch out for in your contracts when you're perusing housing is like whose responsibility it is to or whose responsibility is it to fix damages also upon your first entry of your appointment if you find any flaws any cracks any peeling off the walls whatever take pictures of it because that means you already entered as is you should not be obligated to pay it because it should have been the landlady's or landlords you know duty to have these fixed because he didn't cost all these damages so again upon first entry into the apartment make sure to take pictures of any damages peeling or whatever that you might see another is a void rental furniture yes rental furniture some landlady's landlords they tie up with these rental furniture companies and they get a cut you know like a commission for every Filipino nurse that takes advantage of that rental furniture I just hate it I hate it because rental furniture is a waste of money one friend of mine she ended up paying 170 bucks for a rental bed every month for three months and after three months they take away that bed it's not even rent to own why would you pay $170 for a rental bed when you can just get a $300 new bed from Walmart which includes the frame and the mattress and everything you know what I mean so avoid rental furniture if your agency even said said rental furniture tell them to shove it up where the Sun don't shine what another thing to watch out for your contracts is the fact that it's mandatory to have a car loan as I've mentioned before there are many ways out of this you don't need to be trapped in a stupid contract that will have you paying exorbitant fees out of pocket you don't need to have a car loan that has really observant fees right away the Monte deplane from the US what you need to do is consult your relatives living in that state to help you get a car consult with friends ask for their help in passing the entrance exam you know cuz like you go to the DMV get the booklet study whatever and then ask for the help finding a rental car or a second-hand car a great car insurance it could be Geico it could be progressive whatever just avoid any car loans that have really exorbitant fees because trust me during your first six months in the u.s. you need every penny of your salary going to pay your loans and go to your family and making sure that you guys actually survive so that's one other thing to watch out for and that might be bashed for that you know that thing about Carlos but whatever any of em in North Dakota I met someone who ended up being trapped into a car loan agreeement and she ended up paying certain fees because duh zero credit history and good thing other other friends of mine were smarter by the time they got to North Dakota I still don't have a car because I have drivers anxiety you know we we had a death in the family the night before and took my driver's exam hence I failed doesn't mean I have not retake it I'm still gonna retake my driver's exam I'm still gonna drive but there are ways to get around the city or the town without having a car apart from just the cab and the bus there are other ways and even if you've already passed your corrupt exam again you can do the rental car or you can buy a second-hand car here in North Dakota I'm secondhand cars are a very big thing and and tell you a lot of my friends who are also nurses saved a lot when they use second-hand cars especially during winter mean shed but I know maybe kannababu Sasaki babbu tiles I'm sorry bubble tires and then all-wheel drive that was I had a bus full of you bread useless no it's really a waste of money you know what I mean and during your first six months in the u.s. you need every single penny you can get another thing you need to watch out for in your contract and I think this might be the last because again this is a very long video would be your working conditions if you're working hospitals chances are the nurse patient ratio is regulated so often more often than not you know hospitals are kind of afraid of breaking that but if you're working in a nursing home unless you're in California no such regulations exist so meaning should your employer say you know the nurse and the other floor is absent so you'll be handling a hundred patients or residents yeah it has happened I will not say who will not say why don't I'll not say where but yes it has to happen more often than once may come on just when we think that the days of handling 100 patients are over or 100 residents are over in the Philippines then you come to the US and you encounter the same thing also you need to be vigilant when it comes to your working hours are you working eight-hour shifts are you working 12-hour shifts are you working minimum of four hours overtime or are you working minimum of two hours overtime and what not because the pay does vary also another thing you need to watch out for in your contract or other need to esthar own is if your hospital or the nursing home that can be deployed to is known for having their staff work not just understaffed but also working more than 24 hours I know it is true New Zealand this has happened but I also know that in the u.s. this has happened when a certain nursing home mandated a certain med and a certain nurse to stay 24 hours that is illegal my friends and they got into deep hot water for it and yes other nurses just don't fight back which sucks but if you don't fight back when your employer does this to you they'll do this to other nurses not just you so
