how's it going everybody the liquid theory here what I want to discuss today is what you can do before a judgment is made against you and this is regarding particularly child support where they're trying to put you on trying to get a judge to render a child support order against you and you're a fit parent again everything I do is for fit parents if there's evidence to show that you haven't been fit you abandoned neglected your kids put them in danger in any it's not gonna work for you because they're going to be able to now rebut anything that's you know said in something like this this is for fit parents before a judgement now something like this has worked now for a few people the first one was about over a year and a half ago a cease and desist letter is basically to tell somebody to back the hell off and show them maybe a couple legal reasons why they should and if they don't then there may be legal action brought against them I highly recommend that if you're going to say that you may bring legal action against somebody that you know how to do that or you have somebody that knows how to do that that that may do that for you but a cease and desist letter in this case may be in every one of these cases they got a letter from the state saying just mail in the mail saying sometimes you are being sued you have to appear at this date at this time at this location and you need to bring your w-2s and any other financial statements and anything else so that we may establish a child support order first of all just so all of you are very clear on this there is nothing legal about them sending you a letter and then you having to go to anything that is not proper service in every state the law is clear that if you are going to bring an action against somebody which is a lawsuit then you must have proper service every state has service laws in the statutes that show exactly who can serve people how they can serve people and that must be done in that way if if let's say the state tried to serve somebody and they couldn't find them or they were ignoring them and they were actually served by a process server but the process server maybe they live in a big house with a huge gate around it and they just can't get through the gate well the process server could just leave the papers there but the problem is is that at that point nobody knows what's happening what happened to the papers maybe somebody came along and took them so what they'll do is they'll ask permission for the court from the court to serve them differently maybe it is by mail but there's going to be a court order saying first that they can do that it has to happen in every case so just so you know when you get a child-support letter they that is not service so something that can be done for a fit parent is something like this example a basic heading this is by the way a cease and desist letter is not really a legal document basically what you're doing is establishing a record with a document that you've already pre warned them here's some things these are facts if you think I'm wrong then you're gonna need to prove me against these forget these against me and then if you don't and you keep harassing me then I will have a legal cause of action because that's harassment there's all kinds of infliction of emotional distress these things are they're very they're hard core especially when you feel like now all of a sudden you're feeling like you're a criminal because you were just you had kids and you have been taking care of them well this has been successful if you guys want to try to use something like this of course you're gonna it's up to you I can't tell you what to do but this is it's very interesting because you're going to see even though this is not a legal document it is sort of put together like a basic motion but it's you know it is it's just in a slightly more professional form than just regurgitating a whole bunch of stuff on a piece of paper and a bunch of law that doesn't make sense this is going to make sense to you so of course we have a heading and it's called cease and desist actions for title for D child support you can you know this is not a legal document like a motion or a complainer so you can kind of make that whatever you want and I start off here I John the liquid theory dough now gives to Jane Doe DCSS of Los Angeles County in the state of California to cease and desist any and all actions against him regarding the establishment of title forties child support now again I just I used California in Los Angeles County as an example so of course you're gonna you need to conform this to wherever you are now here's a theoretical statement of facts on or about nine twenty two thousand eighteen I'd received notice from DCSS stating Jane Doe opened a case through DCSS in the interest of Jamie dough our daughter the natural child of the parties the notice from DCSS is to establish child support under the title 4d program of the Social Security Act the notice describes Jane as a custodial parent and refers to me as a noncustodial parent DCSS also sent a request for financial information to my current employer I do not have a history of violence abuse or other criminal history I am fit to raise my child or children as I see fit and it shall be presumed that I will honor my duty to support my child as I see fit that sentence is purely derived from much case law that shows that we have the right to raise our children as ice as we see fit I'm not applying any law there they're gonna have to try to disprove that that claim and let's see him do it let's see what kind of laws that they may be able to you know or anything that shows otherwise than that I do not at any time waive any rights to raising and supporting my child or children and I will continue to raise and support them as I see fit that is a very important sentence if you don't want to right waive any of your rights you better tell them right off the bat because I've seen in other cases where somebody didn't argue that and then the attorneys for the other side are saying well they didn't argue that because if you don't argue something you waive your right to argument later if you don't argue it in the trial court you can forget about Appeals so I also I do not agree at this time to entering into any binding contracts with DCSS or any other agencies regarding Title 4d child support you're gonna see law supporting law below on why I'm I'm saying that statement equal joint custody of the child will be in the interest of the child so may if you're both getting along and you guys want equal custody fine if it's sole custody fine that you conform this stuff to your particular situation I shall fulfill my duty to provide for the needs of my child as I see fit as other fit parents do without interference of the state or title 4d agencies regarding child support a court order for child support against my will shall cause me extreme stress loss of a normal life and or other damages will not be in the best interest of my child or children and will violate my unalienable constitutional freedoms to parent as I see fit now it is always important if you're going to be damaged by something in some way to let them know most of most people are so when when you're trying to figure this out watching all these YouTube videos and you're trying to understand the law you guys forget about the facts and you guys forget about the facts of how it can damage you you're just a splattering a bunch of law out there and nobody knows really what's going on but if it's true you need to let them know because at least you told them at first you are now establishing a record if they want to go against you and they they just say to hell with this kid he's Pro say he doesn't have an attorney we're gonna make an order against him and then what well at least by law if you if you have put on record in some way that and even a record that you just sent them this letter certified and they've they've signed off on something they received something right and you can tell the court well this is what I've sent them I've tried to tell them this and they will not stop and if the court makes a bad decision maybe they abuse discretion had a lack of discretion or there was abuse of process or a million other things that can happen at least if you're arguing that you can bring it up into the appeal courts if you need to so we have issues in supporting long I like to sometimes put issues in maybe a question form you can put it in a statement form it's up to you number one do agencies in the state of California operating under the Social Security Act for program or any other person at this time have a right to order child support against John the liquid theory doe and then what I now do is give them the three main laws through the title for program that and you're gonna see here it's it'll because they're all about title 4d oh no there's support obligations here right so unless there was a court order that was made saying well yeah he was abusing his kids and he's got it you know that's totally different this is now going to from title from the support obligations we're gonna tie this all the way and you're gonna see right here we're gonna read this entire thing how it tie it ties into section 403 where there's a voluntary commitment by the non-custodial parent so 456 support obligations the equivalent of that law is 42 United States Code 656 a 1 the support rights assigned to the state pursuant section 408 a 3 remember that because we're gonna read that next or secured on behalf of a child receiving foster care maintenance payments and that is under title 4e okay which it does not have anything to do with you shall constitute an obligation owed to such state by the individual responsible for providing such support such support such obligations shall be deemed for collection purposes to be collectible under all applicable state and local processes okay and then it I'm not gonna number two is the amount of such obligation and then it goes but the most important thing is they're tying this if that's title 4d they mention section 408 a three I recommend highly that all of you go look this up for yourself I am going to make another video of just those three laws and how they tie it and show you through the actual Social Security website those laws okay but I highly suggest that you go look them up for yourself so under title for a under Section 408 3a which is what section 456 just reference to states the following there is no assistance for families not assigning certain support rights to the state now just that doesn't say no assistance for families for a mother or a father or an individual it says families right so that means multiple people have to assign their rights to the state and then following that it says a state to which a grant is made under Section 403 which we're going to see next shall require as a condition of paying assistance to a family under the state program funded under this part that a member of the family assign to the state any right the family member may have on behalf of the family member or of any other person for whom the family member has applied for or is receiving such assistance to support from any other person not exceeding the total amount of assistance to so paid to the family which accrues during the period that the family receives assistance under the program so that's saying that that a family member needs to go assign the right to the state of the other family member but here's the thing this is where the state's decided you know what we don't need to pay attention to section 403 we're just gonna go ahead and you know we're gonna go push you know we're just gonna go push through in orders against everybody because we get the grant money but let's see what section 403 five capital C lowercase triple I triple capital I says it requires a noncustodial parent to voluntary enter into a contract which would bind him to the provisions of Title 4d I'm sorry that's that's my statement I do not agree and I will not be forced tricked or cursed into entering into any contracts regarding child support and then this is what that section says and I've done a video on it already but I'm gonna read it again I again this says and it's in right here in their rules in the case of a noncustodial parent who becomes enrolled in the project honor after the date of the enactment of this clause the non-custodial parent is in compliance with the terms of an oral or written personal responsibility contract entered into among the non-custodial parent the entity and unless the entity demonstrates to the secretary that the entity is not capable of coordinating with such agency the agency responsible for administering the state plan under Part D which was developed taking into account the employment of employment and child support status of the non-custodial parent which was entered into not later than 30 or at the option of the entity not later than 90 days after the non-custodial parent was enrolled in the project and which at minimum includes the following if you're enrolled in the project that means you had to go in and agree to it do you not agree with me on that and so then they say well now once you agree to it here's all the stuff a commitment by the non-custodial parent to cooperate at the earliest opportunity in the establishment of paternity of the minor child through voluntary acknowledgments or other procedures they have to be procedures that are not violating any laws they just they don't they can't just say oh well we've got other procedures trust me and that's what they're doing and in the establishment of a child support order BB a commitment by the non-custodial parent to cooperate in the payment of child support for the minor child which may include a modification of an existing support order to take into account the ability of the non-custodial parent to pay such support and the participation of such parent in the project you're at this you're agreeing to this this is a full commitment a commitment by the non-custodial parent to participate in employment or related activities that will enable the non-custodial parent to make regular child support payments court-ordered and if the non-custodial parent has not attained twenty years of age such related activities may include the completion of high school now they're gonna force you to do that of course a general equivalency decree or other education directly related to employment this is you're saying yeah okay well I'm gonna go ahead and agree to do this and under DD a description of the services to be provided under this paragraph a and a commitment by the non-custodial parent to participate in such services that are designed to assist the non-custodial parent obtain and retain employment increase earnings and enhance the financial and emotional contributions to the well-being of the minor child so see what they do there is see now you're agreeing to all of the title voor d well you know you read through title 4d it's all the stuff that they now can do to you you've agreed to have your passport taken away to have to whether your situation is like that or not you know and this you've had a judgment there's a and they've just thrown you onto it what I'm saying is as the law is very clear that absent abuse neglect abandonment thing like that you have to agree to participate into this and they stopped saying that a long time ago well we're just gonna go ahead and do it if we send you a letter and you show up and you bring your stuff now you're just agreeing to do all this you know that's how they're doing it with most people and so though and if they decide to do that as long as if you have established a proper record then you can tell them and appeal or in later courts that that is not the case what they said I should have not if there was no record of a voluntary commitment through these three through the laws through title four or any record of abuse and neglect or anything like that then if a court puts a judgment against you then theoretically it can eat it can it can be voidable it may be void if they never acquired subject matter jurisdiction or personal jurisdiction but that's for a different that's for a di ferent video to explain all that to you okay so if they make that order then you can they they're gonna have to come and prove with you know maybe a statement of facts or a conclusion of law which in some states you can request right after a judgment is made for the judge to have to put in and you know what exactly what was the evidence that why why did you make this decision where's the evidence and what laws are you know supporting your decision and that's important because it is possible to to vacate these decisions because they are not doing things correctly and then above and beyond that if if you know enough about the law and you study enough properly then you will understand that if you have damages being brought that that are done against you then you have proper causes of action in which that you can present to the court through a proper drafted complaint that will be sufficient to now which without any kind of dismissal because it will be sufficient they're gonna have to answer to it and I guarantee you people that at some point that they're not making this easy for everybody but if you establish the record the higher you go and the the better your facts are the more precise your facts are the better chance you have of overturning a bad decision and that is how this stupid game is played okay but so here's issue number two I'm just throwing this out here can a contract regarding child support against my will be valid well we just read everything about that right so well plus contract law is very clear no there's there is much primary Authority which governs the validity of any contract a proper contract must contain all of the essential elements including a proper meeting of the minds full disclosure by the parties involved voluntary commitment by all parties involved to agree to stipulations including included in a contract competence of the parties agreeing to the contract and proper consideration exchanged by the parties any contract that does not contain any one of these elements cannot be valid be a valid contract and cannot be valid by court order or enforceable by law so now we're going to tell them well now so if you want to say that you're just pushing this through well here's the law that says in my particular case that I was supposed to enter into this contract so now again there's a contract which they will make an order upon if they if they proceed but attacking the you have to attack that final judgment because the because they're basing a judgment on something that's not property but again I've got to do a whole nother video on that there's a lot of things that you guys need to start becoming aware of if you're going to even attend to try to competently attack these things on your own the third thing that I want to tell them is that there is no proper cause of action for which the court can grant relief upon so that particular sentence you probably a bunch of you that have gotten paperwork from some of these other guys have seen that little you know that little clause somewhere somehow in your papers when they just got turbo dismissed once you once you put them in especially with lawsuits if somebody has paid somebody else doing YouTube videos eight to sixteen hundred dollars to file in a federal court you have probably gotten a dismissal for a lack of a proper cause of action for which the court can grant relief upon again I'm gonna have to do a whole nother video on just explaining that there is a lot to this stuff so you guys have to learn it the right way otherwise you guys are gonna have a very difficult time so is there a proper cause of action for which the court can grant relief upon well no because Black's Law Dictionary six edition defines a cause of action as the fact or facts which give a person a right to judicial redress or relief against another which would be and it says further down in the definition a failure to perform a legal obligation to do or refrain from performance of some Act now that is very broad that can be anywhere from going up and hitting somebody with a baseball bat to just sitting there on the bank and watching somebody drowned now if you didn't have the ability to of course you didn't want to cause you know put yourself in danger but if you went out to try to to save somebody in the ocean and you weren't a very good swimmer and the lifeguards see you way out there trying to save them and then all of a sudden you get scared and come back and that person drowns believe it or not because of that action even you know you gave the impression that other people could you know that are professionals you're already way out there and then you turn back and now there was nothing they can do you can get sued for that that is a lack of performing some sort of an obligation because you shouldn't have even gone out there you know you may not have had a direct injury to that but your actions caused other people to possibly think well that guy is going to be able to save her or them whatever so there's in causes of action are there's many many many causes of action but they have to be able to say that you have either through something you've done or didn't do you know if you abandoned your kids then you're not there you're not performing a duty if you've just said to hell with it I'm out of here to hell with them but if you're beating your kids then that's you know I mean I'm sorry not beating your kids if you're well I mean I guess I could say if you were beating your kids they have a proper cause of action let's put it that way because then they could say well here's the thing this is what he's doing here's some evidence to show it now we've got a cause so now we can bring in legal action against you right but most of these do not say what you know many of them especially just these letters through the child support agencies aren't saying that you're doing anything wrong so by law they don't have a proper cause of action for which the court can grant relief upon if if they're not saying that you've done anything wrong well theoretically then there's nothing that the court can do even though they are in a lot of cases but there's ways to have to attack that the right way to remedy that you know so this whole thing is basically showing them here's just a few things these things can be drafted in many different ways with all kinds of different stuff as long as the facts are there and and and they can be supported by you know I mean if somebody can prove to the court that you're unfit then something like this will establish what they call the preponderance of the evidence in court because especially if you get a sworn affidavit that is saying that you know maybe the in the statement of facts part of it because it's got to be about the facts you know affidavits don't contain law but everything that may be in the statement of facts is true and correct well if you know that there's no way that somebody can actually prove that against you then that is in your favor you've got an exchange with the other parties you're showing them you know that this is how it is so if you want to continue with this I think you might have a hard time you know especially if somebody knows how to proceed through the court system the right way as a pro se litigant because most pro says-- do not know they don't don't know the basics so and there's no easy way to learn them that's why there's no just real quick a lot of people go well can you just what's the silver bullet in most cases there is no silver bullet especially if you've had a judgment against you because you the only thing you can do at that point is as you have to attack that judgment or fulfill that judgment or you know die that I mean those are the choices once there's a judgment against you right so this whole thing you know we like to put a little conclusion to the end of this where Jane Doe the state of California and a any agency in connection with title four of the child support under the Social Security Act does not at this time have any proper cause of action against myself in regards to establishing court-ordered child support in connection to the title four program one who supports their children or will support their unborn children already fulfill or shall have the presumption under the law to fulfilling the duty of supporting their children precedent course cases clearly show that fit parents have the right to raise a child as they see fit without any interference I shall have the presumption that I will probably properly fulfill this duty there is no evidence that I do not have the capacity of providing for my children as I see fit I currently do not agree to enter into any contracts with any agency regarding title 4d child support I will not tolerate harassment of any person or agency under the guise that it will be in the best interest of the child or children and any actions by any agency entity and/or persons may be liable for any damages caused by attempting to establish by court order a child support against myself it is also clear that the states the title 4d agencies and other entities involved with the establishment of parentage establishing and enforcing child support orders and other actions under the title 4d title 4 of the Social Security Act receive federal grants for these actions and is considered to have a financial interest like to end it with that because now I mean they can't there's absolutely no way they can prove against that so of course the reason why the child support system is so corrupt because it's about the money and you know if they if they all of a sudden won one of the the parents goes in and plows for child support and then they just force somebody else on child support unlawfully which is what they do most of the time then they get money and then the other person that filed gets money and then that person that parent or the custodial parent maybe they they spend the money on their are their kids maybe they're you know paying for blow and hookers you don't know and that's the problem big and then all of a sudden in a lot of cases because it's so easy for many of these custodial parents to get a child support ordered against the other person then you start getting we're the so-called custodial parent is now throwing it in the face of the non-custodial parent and making it worse purposely trying to make them angry shoving it in their face you want to talk about what the real problem is with what's happening here in the United States it is the division of families and and the separation of the children from fit parents for money and some of you out there wanna you guys are concerned about how their so-called you know separating families at the border that is the least of your worries when they're doing it here and this is why in my opinion why the United States and why people in general are so screwed up in the head because the family structure has been destroyed and the number one key to that is this title for program I guarantee it so we'll end it with the cease and desist let this be notice that I demand any person agency or entity to cease and desist any and all action against me regarding child support in connection with title four of the Social Security Act regarding this particular matter I do not waive any of my rights in any actions regarding this subject matter may cause any injuries which may cause any injuries to me in any way may result in legal actions against those persons agencies or entities you have now given them notice you have now established some sort of a record at least in the beginning they're gonna have to prove against any of this some of the attorneys the assistant attorney generals or the Attorney General's for States get this these kind of things and they don't know what to do with it because it's not a bunch of frivolous stuff if the facts are on point they're going to have to disprove against that if the law is on point they're going to have to disprove how these laws that govern what they do don't apply to them and so now the the at least at least the four people that I know of that have tried this that I have been able to try to educate them on how to do this on their own have succeeded pre-order is much easier than postorder we are going to see in the future I'm gonna be bringing the entire Texas case to you about what happened with this person to over two years I worked with him educating and studying with him on the laws the proper laws on what to do the right way he made it all the way to the appeal courts he was able to learn the right way and not have his stuff dismissed but it wasn't easy he had to put a lot of time and do not go down any of the rabbit holes like many people do because that will get you in trouble at the end certificate of delivery you can make it very basic just saying that you know your this is not really a you know really legal certificate of delivery when you fill out actual an actual complaint we're in the middle of a lawsuit you're gonna you know a lot of states wants you to certify that you have actually sent them a copy well it's not you know because this is not an actual legal document then this is good practice for you to just put together a quick certificate of delivery delivery by saying that you have in some way whether it was by mail certified mail however have given him a copy of
