zero zero two one nine eight zero and today we will be talking about the step-by-step process of transferring a land title here in the philippines but before we proceed if you are new to this channel the processing or transfer of a land title can be tedious and a long and painful process and here in the philippines it takes months or even years if there are problems with the documents and records so i'm going to tell you what are the required documents the government agencies you need to go to and the step-by-step process to transfer the land title to your name first here are the list of requirements you need to have on hand original copy of the notarized deed of sale or das plus two photocopies owner's duplicate copy of the transfer certificate of title or tct or the condominium certificate of title or cct in case of the sale of condominium unit plus two photocopies certified true copies of the latest tax declaration for land and improvement of the real property plus two photocopies and if the property sold is a vacant lot or no improvements have been made on it a sworn declaration of no improvement by at least one of the transferees or certificate of no improvement issued by the city or municipal assessor's office tax identification numbers or thin of the seller and the buyer and additional requirements if applicable special power of attorney or sba if the person signing on the document is not the owner or appearing on the tct or cct and certification of philippine consulate if the sp is executed abroad location plan or vicinity map if zonal value cannot readily be determined from the document submitted and such other requirements as may be required by law rulings and regulations or other issuances now here is the process the first one is once your documents are complete you need to proceed to the bureau of internal revenue or bir revenue district office or rdo that has jurisdiction over the sold property now for more information as to which rdo your property belongs i will leave a link in the description below then you need to submit your requirements to a bir representative who will compute the capital gains tax or cgt and the documentary stamp tax or dst and once the computations have been done the bir representative will have you sign three copies each of bir form 1706 for the cgt and bir form 2000 for the dst once this have been filled out all your documents will be given back to you the next step is for you to go to the authorized agent bank or aab to pay for the cgt and dst a bank representative will ask you to fill out two separate payment forms for the cgt and dst and after payment do not forget to get a copy of the payment forms and make sure they have been stamped received by the aab i will also put the link of the authorized accredited banks in the description and comment section below and just a note to avoid penalties and surcharges the capital gain tax or the value added tax should be paid 30 days from not authorization date and the documentary stamp tax should be paid on the nearest fifth day of the month following the notarization date be very careful of the date when your deed of conveyance will be not arised and the third step is you need to go back to bir to return all your documents and now including the original copies of the two aab payment forms now once submitted the bio representative will give you a claim slip with the date when you can claim the certificate authorizing registration or car the car is required by the register of these for the title registration and the issuance of a new owner's duplicate original copy of the tcp or cct and as dictated by br memorandum order number 15-03 bir revenue district office are required to release the cars for all one-time transactions or on it within five days of submitting all your documentary requirements these are the documents that you will receive on the day of the release of the car original copy of the deed of absolute sale stamp received by the bir owner's duplicate copy of the tct or cct original copies of the bir form 1706 and the form 2000 stamp received by the bir copies of the tax declaration for land and improvement then go to the treasurer's office of the lg where the property is located pay the transfer tax and secure a copy of the tax clearance now this will be handed over to you after payment and once you have presented the following documents original and one photocopy of the deed of absolute sale photocopy of the tax declaration official receipt of the payment of real property tax and special education fund tax for the current year now once you're done with the treasurer's office and submitted the documents you may now proceed to the register of deeds the rd computes for the registration fees now to receive the new owner's duplicate copy of the transfer of certificate of title or condominium certificate of title you need to present the following documents original copy of the deed of absolute sales stamp received by the bir plus three photocopies sellers owners duplicate copy of the tct or cct original copy of the car original copy of the tax clearance original copies of official receipts of payments of the cgt dst tax clearance certificate and transfer fee and the original copies of the current tax declaration for land and improvement issued by the local assessor's office if the seller or buyer is a corporation submit the following requirements secretary certificate authorizing the sale of the real property certified true copy of the articles of incorporation and bylaws of the seller or by your corporation and once the registration fee has been paid and the documents submitted a new owner's duplicate copy of the tct or ccp will be released to you within two weeks and then you proceed to the local assessor's office for the issuance of the tax declaration in your name and here is what you need to submit photocopy of the deed of absolute sale photocopy of the tct or cct photocopy of the car photocopy of the transfer tax receipt photocopy of the latest receipt or tax clearance after submitting all of those documents you are finally done you now have a new title a new tax declaration and the brown copy of the bir car or the certificate authorizing registration so there you have it the documents needed and the agencies you need to go to to process the transfer of title to your name and i know the process can take long but this is the only way for you to protect your investment and to make sure that you have legal ownership of the
