While I’ve never been told that I couldn’t be on a business’s premises before, I have been part of the process of telling someone this.Half a decade ago, I was the CFO of a general construction company and the manager of its ready-mix concrete plant subsidiary. My lateral counterparts were the construction foreman and the VP of the corporation, but I reported directly to the President. Any of us could hire or fire people.Because I was, among other things, the person who oversaw our main office and the money of the corporation, and the Designated Employer Representative (DER) for our drug and alcohol consortium, it would be normal for me to be part of situations to get rid of people.Usually, I didn’t hire people for other managers, because I wouldn’t appreciate others hiring people to work in the stuff I ran. However, if the construction company needed general laborers, I might hire these if the President or foreman said one or some were needed. — In this case, I’d hired a guy as a general laborer based on the sole qualifications that he had a valid driver’s license and a car of his own.In Texas, because of the Driver Responsibility Program (DRP), — a government-authorized racket, in my opinion — it is common to find qualified applicants who have no valid driver’s license (DL). — Perhaps, at the concrete plant and related trucking operation, having a valid commercial DL was a bona fide qualification, but not so much for a bona fide construction worker.You get a speeding ticket. You get a fine (under the criminal code) and a “surcharge” (under the DRP), and when you don’t pay the surcharge, then the private organization that administers the DRP tells the Department of Motor Vehicles of your noncompliance, and the DMV then suspends your DL. — A judge doesn’t review the evidence. It’s not like the DRP tells a magistrate to review the case and then the magistrate orders the Texas DMV to invalidate your DL. — It’s just some customer service representative talking to some other CSR, and they make mistakes.It takes less than 24 hours to invalidate your license but up to 7 days to reinstate it, even if it’s their mistake.Your speeding ticket was a Class C misdemeanor. If you are driving while your license is invalid, which you may not know, then you may get charged with a Class B misdemeanor, which is the same thing as a first-time DWI. — This will get you another surcharge.This vicious cycle makes it almost impossible for people of a certain class ever to get out of the system, and it appears to be a program with a double-jeopardy problem.When I was President of a local civic club some years back, I got all of the local civic clubs to have a joint meeting, for the first time in decades, and as our guest speaker, we invited our state senator.After it was over, I went over to him to thank him for coming and asked him what he felt about the DRP? — His response was, What do you think about it? — I told him it got in the way of my hiring process and probably was unconstitutional. — He invited me to email him about my concerns. I never got a reply to that email, and he never did anything about it. And, he’s a respectable Texan politician. — I have to mention that, because we have so few.The first day the guy I hired worked, he showed up on time with all the normal things a construction worker/general laborer is supposed to have: gloves, lunch, water/thermos, tape measure. — He passed his initial test by the construction foreman, and he was sent to a job site to work for the day with some other guys.This job site had a controlled entrance and many rules that we had to follow, as a contractor, just like employees of that company had to follow. — It was a rather secure area.Too bad his thermos was filled with liquor.His coworkers noticed, eventually, that he was drunk, but they did not report this to the foreman, who was not on site, or to anyone else. — Subsequently, the guy just kept getting drunker and drunker.It was only when all of the guys got back to the main office (back shop area), to end the day, that the foreman was notified.Around this time, I got a call from the foreman to come back from the concrete plant to the main office to deal with a situation.I called my office assistant and told her to figure out how many hours we owed him for, for working that day, and to make out his final paycheck.When I got to the office, the drunk guy was sitting in the lobby area, surrounded by other construction workers, and with the foreman present. He told me that he was going to terminate the guy, and I said we were already preparing his paycheck. — That we were required to pay him.The foreman asked me to call his mother and tell her that she needed to come and pick him up, because he wasn’t going to allow him to drive away. — When I looked at his employment application, his mother was listed as the emergency contact, so I called her and told her that everything was okay, but that she needed to come to our office because it appeared her son was intoxicated and we were not allowing him to drive away, for his benefit and the benefit of others.She was audibly upset at the situation but said that she was on her way.The foreman, who was old enough to be the guy’s father, but just barely, went over to the drunk guy and told him that he was fired and that he was not to come back to our premises. He was not to be at the office, in the back, in the shop, on any of our job sites, or at any of our locations.The guy started to protest about his job, but stopped pretty quickly when the foreman asked him what he had in his thermos.At that point the guy wanted to leave. — His car was parked out front, and he got up to leave. Smartly, the foreman got in his way and told him no. That we’d called his mother, who was coming to pick him up, and that we were not allowing him to drive away. It was not safe for him or anyone else.He got mad but knew he was wrong. He kept trying to get out of it and leave the lobby so as to get in his car, but each time, the foreman stopped him.What I was doing during this time was documenting everything I saw. — You document these situations in a manner that is observable, articulable, and contemporaneous. — I’ll remember those three words, probably, for the rest of my life due to a stupid online course I had to take once.When his mother got there, she came to me, basically in tears but holding them back as best as she could, and apologized. She told me that this was not the first time it’d happened.I told her that there was no problem. I gave her his paycheck. — I said that we had no problem with him and that we understood people had problems, but that he would not be allowed back on the property. Any of our properties or job locations. For any reason.The natural thing that came up next was — what about his car?It was a Friday, and she asked if she or one of her relatives would be allowed to come back the next day to pick up his car? — I said that as long as he was not the person coming back, that they would be welcome to come and pick up the car; it would be best if it were gone before our next business day.With that, she got him and they both left. — I never saw either of them ever again.This one guy’s actions caused a multitude of people to stay late for the day. I had to leave what I was doing at a concrete plant to come over and deal with him. I had to go back and finish what I was doing after that.There was no written rule that a terminated employee could not be back on company premises. That was something — I think smartly — that the construction foreman came up with based on these unique circumstances.I also thought it was special — a testament to the caliber of people who worked there — that many of the other workers stayed after work to make sure this guy did not leave the office and get back into his car.It’s not that he would have been physically restrained. We would just have had to call the police.Much was done for the benefit of someone who was, basically, a stranger. For many, this was done off the clock; they were not getting paid to stay, and some of us were salaried.Partly, he was not allowed to come back because we didn’t want the liability of his drunk driving coming back on us. — Businesses have much higher limits on their (commercial) auto liability insurance policies. Typically, 1MM/2MM (i.e., $1,000,000 per incident, $2,000,000 per policy period). That’s standard.The other reason was theft. Sure, there were saws and torches and all sorts of things he could hurt himself with if he came back drunk, but these things could also be stolen.When you hire someone, you give him or her, in at least some form, “the keys to the place”.When you terminate the employment of that someone, you stop his or her income stream. The possibility of theft rises dramatically. Especially in the construction industry.

Yes, Google Forms responses are stored in a worksheet that can only be accessed through a Google account login. The transmission of data uses SSL to encrypt the data during transport (but not in storage!) The data is as secure as most other systems which take survey data and store it.Anything that you would normally store encrypted should NOT be collected using a Google Form. This would include passwords, social security numbers, credit card numbers, medical data, etc. Even though it is stored securely on the Google servers, your password could be stolen or hacked, or the Google servers could even potentially be hacked (unlikely but possible.) If that happened, you don't want to be storing in plain text anything that would be catastrophic for it to be stolen.
