some briefings on some of the covet safe practices that we're asking here at the state for our employers to follow so that we can make work as safe as possible for our workers and for anyone using your facilities i'm very very happy today to be joined by greg marquez who is the osha compliance manager with the new mexico environmental department uh jeff whittie the secretary of the new mexico department of agriculture a long-term veteran of that position and robert hegavort an nmsu extension dairy specialist as well as tom dean who is the southwest director for the nmsu cooperative extension service and co-director of the southwest border food protection and defense center so what we'll do is i'll run through a powerpoint fairly quickly with some of the main topics we're looking at i'll turn it over to mr marcus from osha if he has anything to add i know mr hagerboard mr dean have a few things they want to add and then we'll go to questions if you do have a question there should be a chat feature for you on this zoom broadcast please type in who you are what uh employer or organization you represent and what your question is and stacy johnston from our public information office we'll read that off to this very august group of folks that are here today to answer your questions and we'll move from there so thanks again and we'll get started uh stacey can we go to the next slide please so a lot of times people have some confusion about what the state agencies are and what they generally do so running them down real quick the occupational safety and health administration is actually it's a federal law osha is a federal law it is enforced at the state agency by the new mexico department of the environment and these are the folks who are in charge of making sure that workplaces are safe and healthy for all new mexicans that are here working in new mexico the department of health during this whole covid situation are the folks that are actually on the front lines of developing the guidance for health standards for the whole state our shop at the department of workforce solutions is in charge of assisting with both workphrase training and placement as well as we run the unemployment shop which is as you all can imagine been fairly busy and then the new mexico department of agriculture is in charge of overall licensing and kind of overseeing the agricultural interests of new mexico from a big picture perspective and also promoting all of the wonderful products that you all put out in terms of our milk and cheese and cotton and chili and pecans across the nation and the world next slide please stacy so what are some of the overall practices that are required by every single employer in the state of new mexico uh as we you know work through this pandemic firstly anything that can be operated on a remote level so any of the different types of office environments accounting hr anybody in your shops that may be able to work remotely we are asking they do work remotely for people that have to be on the job site and in many of your offices and facilities that that is required please make sure there are six feet of distance between anybody whenever possible and you know some of the things that we point to are if you see grocery stores they do a pretty good job of marking six feet in checkout lines or putting arrows between aisles that sort of thing any kind of social distancing helps us beat this thing in terms of not spreading the virus to one another make sure you try to close common areas you know where people congregate these are break rooms uh outside areas where people tend to smoke please try to limit those spaces as much as possible because people are naturally gonna try to be social and the more we can stop that from happening the more we're gonna limit the spread of the virus once again any kind of remote meetings whenever possible please do that please ensure all of your employees have face masks and wear them this is one of the biggest things that we can do and more and more of the research is showing that not only do face masks provide a little bit of a protection for you please let understand that they really protect other people because when i'm breathing out or when i'm talking the more i'm wearing a face mask even if i'm within six feet of someone else the more likely it is that that other person is going to be safe and if you're both doing it it's a lot more protection so that's really important how can we train employees that's an important thing and how to stay clean and keep their workplace and all of their equipment clean as much as possible so that we can stop the virus from spreading over objects that we touch and then how can you make sure that everyone in your facilities has a hand washing facility that's available or other type of sanitizer so they can keep their hands clean the more we keep our hands clean and stop touching our face the more we can stop this virus from spreading next slide please there is an ask by state agencies that you try to screen your employees every day and if someone comes in and they say they've got a fever or you can see that they've got a fever with a thermometer if they're coughing all of these different symptoms please send them home and ask them to get a test tests are completely free and you can find out where to get them at the department of health by clicking on that link below and for everyone who's watching this right now we are both recording this presentation and we'll have the written presentation available on our website at dws.state.nm.us so you can click on these links from there next slide please so what are some of the recommended best practices for following those requirements try to have a really good communication plan so everybody knows what the deal is and how to keep themselves clean and socially distanced it's been a really good practice in other places that we've found for there to be a team leader or someone someone in the workplace whose job it is to really communicate all of these different things as they go along to your workers and finding either a team or just one person depending on how big you are can be very effective try to say if i've got vulnerable employees and i'll be talking about that more in a second but if i've got someone who's got a high risk of getting coveted or having a an adverse reaction to the virus or if someone is older is there a way they can do different things that are going to keep them from interacting with other people try to keep a daily log i notice some gyms are doing this they're making you sign in when you go in and sign in sign out when you go out and that's really important for a thing called contact tracing so if there is a positive test at your workplace knowing who they were around will allow those other folks to get tested too and then quarantine and that's one of the ways we can beat this thing you're seeing that in the nba as well once they get in that bubble now they're not coming out um so they know who they're interacting with and so far actually this morning not one nba player has actually had a positive test for kobit so this is the sort of strategies that work and if you can work on your hvac maintenance to try to keep clean air that's always a good thing next slide please if you go to that website on top and go to specifically to page 30 there are specific recommendations and practices for folks in the farm and ag industries examples include you know every two hours can you work on making sure that all your equipment and your workstations are cleaned once again making hygiene supplies available finding places where people can either wash their hands or get hand sanitizer or have personal sanitizer bottles that you can give to folks so they don't have to share them around in addition to not sharing things please ask your folks not to share food or beverage containers that's a really good place for the virus to spread and when you can please try to get delivery service established by appointment and have people drop things off and do it contactless that way you can keep folks that are coming to your farm from if they happen to be infected making sure that your folks don't get infected what are some of the best practices once again try to find ways of making sure your folks aren't congregating in any type of manner so if they're going to come in and they're going to check in at a time clock maybe they can come in at five minute interviews can you put in temporary partitions for those of you maybe in the dairy industry where people have specific workstations or the meat processing industry can you actually put in partitions between folks to keep them from interacting with one another can you limit all the folks on your property in your facilities to essential workers i know a lot of people a lot of times like to visit hang out family members it's really important that we limit those visitors as much as possible and once again if people have to show up find a way to set up appointments where you can make sure that they're limited in their interactions with other your folks and make sure that all these coveted safe practices are included in your labor contracts for those of you that may be on farms and signing contracts with some of the the companies that are doing labor for contract services they should know that as well because they're responsible for their folks next slide please i'm not going to go into this too much but if you have less than 500 employees the family's first coronavirus act passed in the middle of march of this year is requiring both paid sick leave and paid family leave for people that have to quarantine or take time off because of the virus you can actually see all of the details here and the way you as an employer get paid back for this is through a tax credit which you can find out on that irs site now this is important for us because a lot of people say hey look you know these people should get unemployment um that's not the case the first time out if they're asked to quarantine for a couple of weeks because either they're positive or some of their family members are positive they're supposed to get sick and family leave according to this piece of legislation first next slide please okay this is a biggie this is from the department of health we at the workforce solutions department generally don't give unemployment to people that leave their jobs voluntarily you generally have to get laid off there's an exception to that though where you can provide good cause for leaving your employer now in normal times that's hey i've had an abusive supervisor or this was an unsafe working condition whatever but during covid we've had to modify our guidance a little bit and say look anybody 65 or older they're automatically going to be given good cause and they shouldn't be coming to work anybody 65 or older is going to be much more likely to have an adverse affection adverse reaction to the virus furthermore the rest of these guys down here so if you've had a chronic lung disease or or asthma you have really serious heart conditions you've had cancer in the past or hiv if you can provide a document from a medical provider about these issues then you generally shouldn't be coming to work and we will give you unemployment next slide please okay that means though that for people who don't have good cause and you do offer them a job they should be coming back to work if you do offer folks a job specifically one that they that should be close to what they had before if they're on an employment they need to be taking that job unless they can provide good cause good cause is not going to be defined as i'm making more on unemployment than i am on my regular job that that's not going to be something that we're going to allow or just a general i'm scared of covid19 that's not going to be either however if an employee has one of those pre-existing health conditions which i just talked about or if they can show that an employer is not abiding by coveted safe practices we can give them unemployment however if you are an employer you can go to that form on our website fill it out send it in if you have an employee that's not coming back to work and you don't think they've got good cause we'll look into it next slide please basically the message we're trying to give is that opening up new mecca's mexico's economy and keeping our economy open in a safe way is a joint responsibility hey if you're an employer we're asking it you follow these public health orders follow these safe practices and do everything you can to make sure that your workplace is safe on the employee side you know if you are getting a good offer to come back to work and you don't have any of that good cause you should be coming back and educating yourself on why that's important next slide please so there's a couple of slides here i just want to put out to the employers we have questions all the time on how do i get masks because obviously they're a requirement under the health order as well as hand sanitizer that sort of thing this website here is for an organization that's been put together by the new mexico association of commerce and industry and is working really really hard to find employers ppe to help them through this and you can email this lady below miss jenae amperon at that email address or next slide this emergency supply collaboration which you can click on once we get this up and running is actually an organization put through by new mexico tech and they're helping folks find ppe as well so there's at least a couple of resources to help support you as you look for these different safety precautions next slide please so secretary witty actually asked me to talk about this for those of you that don't know the new mexico workforce solutions department is actually in charge of overseeing for foreign labor certification many of you with your employers uh generally try to find seasonal or contract employees and some of them may be foreign nationals for more information on this process there's a completely interactive website at that link right there on how we work the labor certifications and the office that actually runs this is at a demanding and you can find their phone number and their email there now we do have people rotating into our offices they are not seeing people face to face but we do have someone on the phone so if you have any questions about h2a or h2b visas and how that process works please work through those resources and next slide i believe that's it it is so i'd like to go over to greg marquez he's the osha compliance manager with the new mexico environment department mr marquez did i miss anything are there any really important issues that i miss that you think need to be brought up mr marquez you might be on mute sir there we go all right apologize about that um first of all thanks for the invitation to participate um i think the slides just based on you know the quick preview of them there was a lot of good information that you covered i think the uh materials at least with regards to best practices and implementation of the primary means of protecting employees protecting ourselves in the workplace uh those are all really really good uh tidbits of information uh and and and for the most part they supplement what we're doing on a daily basis within our bureau here um the the two items that i think i i would add though is that uh at least with regards to um use of uh video in contact tracing so for for many of these employers who have large facilities and high numbers of employees where break rooms uh or lunch breaks and interval breaks are taking place that video surveillance be utilized for the sake of monitoring and and observation of whether employees are essentially maintaining their social distancing so it's a good means of being able to do it remotely by management structure that um may not be at the facility itself um secondly um and this is more through um means of of what we're hearing um oftentimes with the use of these hand sanitizers and they're alcohol-based there are there are some that apparently are making their way into uh the in the mainstream that have methanol in them so just be cautious that if you're providing the supply for the employees that they all contain ethanol so it's an ethanol based alcohol and has no methanol content whatsoever because that we know that that's uh certainly not um good for for one's health and certainly can can cause health issues for longer-term exposures so aside from that i think everything else that was relevant i i would recommend that the use of uh covid safe practices uh page 31 is uh directly related to uh farm ranch dairy producers and food processing we have received a fair number of rapid response investigation inquiries that come our way and we have to look into them what's going on at those types of facilities but overall the the coveted safe practices that have been implemented are what we are in support of the department of health rapid response efforts looking at positive cases in the workplace this information is provided back to the employer so that they have that level of information oftentimes they are unaware i would certainly advise that if um any contact is being made to employers that if they don't have this information that it be brought forward to them okay thank you very very much sir and i wanted to move along thanks mr marquez mr hagerboard you had a couple of different slides that you wanted to go over um i don't know if we can share those or if you just want to talk about stacey can we share those slides yeah i think i can share them from uh where i'm at [Music] i hope you can see these uh so my name is robert hagerford dairy extension specialist at new mexico state university and uh we have uh worked um quite a bit with uh with producers that may have had questions in regards to covet 19 and may have had questions about what to do what not to do and specifically as it relates to dairy and and so there's there's a list of resources that is available both in english as well as in spanish as the secretary was indicating a lot of the employees maybe foreign labor and so there a lot of resources have been developed both by the cdc uh our national malproducers federation uh has also developed several resources that are available on on this slide and i know that this presentation is recorded my contact information is also in these slides hey robert yes so the slides are not showing up they're not showing up i'm sorry for that there we go just they just showed up oh okay all right very good there they are uh so as i was saying this slide provides a lot of cover 19 resources for ag in general and dairy producers in particular those are all in english the particular links are right there both from cdc department of labor and as well as the national milk producers federation that has made uh quite a few resources available uh nmsu has also uh in the college of agriculture has also a uh code 19 resource page that is available on the web and then there is a couple of articles that were written early on in in this in the pandemic how to prevent the introduction and spread of code 19 on your dairy by dr dufrett and rodriguez at the ut school of public health that we have also made available to all the producers in new mexico so this slide is all pretty much all the same resources that are available in spanish and i've had several producers over over the last two months that have asked me for these resources in spanish so they could share those with their with their employees or include them in their paycheck or make them available in any other way or use them to be able to communicate with them and so there's actually also a video that number five right there that altec put out there in spanish uh that actually really is uh is very informational talking about what what is it that the virus does and how to protect ourselves and our families so these are some really good resources uh that are out there um and if anybody has any particular questions in relation to uh issues that may occur on the dairy please feel free to contact me your email phone numbers are on there and would be more than happy to to provide any more information when needed so that is in essence what i would like to share and we'll turn it over tom i don't know if you had anything to add to that from an animation perspective just a real quick addition there on the nmsu aces website for covet 19 some of the information that we've put up for considerations with employees the essential workers in that literature we do have uh back with the cdc and some of the osha requirements some of the free posters that employers might want to have posted around those are available in those resources as well thanks tom i appreciate it uh secretary woodage do you want to have anything that you wanted to kind of close this presentation with sure you know and and i want to thank secretary mccamley and greg for coming on board and talking to our high folks and of course robert and tom dean got a lot of good information but i really want to take a tip of the hat to uh chad's method and the lifestyle bureau with derrick new mexico for really coming behind and bringing this to you to the membership into the high producers across the state we're in the middle of harvest we're always in the middle of harvest in and especially in the dairy area it's a 24 7 365 harvest and what i mean by that is we don't have time to you can't stop you can't close for 14 days to clean a facility you can't not harvest chili or onions or watermelon or lettuce when it's you know after it's primed when it's ready it's ready and and the only reason i bring that up and secretary mckinley brought in a lot of good information that did robert and tom and there's a lot of good information on both the mmsu website and the nmda website at mda.msu.edu but it's critical that we take care of our employees it's critical that we take care of ourselves as producers because if you lose a crop you last a year and we're getting a lot of comments from folks around the state the producers they're concerned about that they're concerned about the labor issues agriculture's always been in a tough labor environment and now when you throw covet on top of that and workers are concerned about their safety you see farm workers across the country that are running issues and we're trying to keep that and so i encourage all of our producers to to step it up and make sure you're you're doing what you can to follow those cult and safety practices secretary mccann we went through a series of ways where employees you know if they're concerned about their health they can continue with unemployment and things like that but if you're following the safety practices that's put out by the state of new mexico you you have an opportunity to really protect yourselves and protect your your employees we can't harvest can't wait till tomorrow when the crops are ready the crops are ready and so you know i i'm encouraged by these kind of seminars to make sure we're getting the word out to everybody and answer questions and as always you can always contact the department of agriculture the extension at the college of agriculture and aces i went back to the old days tom and robert but the agriculture consumer environmental sciences at nmsu great information great resources the same at the nmpa secretary mccamley and the environmental department are also great resources as the department of health we can help you bridge those those uh that information about that so it depends on the mechanism by which the allegation or complaint is received um in our office we have a number of different mechanisms by which they're being sent to us um primarily and i mentioned earlier the department of health rapid response effort where there's positive cases in the workplace um that's primarily being handled by phone calls and emails we have another effort that's a state emphasis program where we're working primarily again with um emails and and phone calls um but if it escalates to a situation where there's an inspection um generally speaking what can be done remotely will be done remotely but if we have to step on site then those are generally unannounced and that's per our our field operations manual and our protocols okay do we have other
