Mary Phagan, 13, worked at the National Pencil Company in Georgia in 1913. Because of a lack of brass to hold the erasers, she had been laid off. On a Saturday she showed up at the factory to get her check for $1.20 from Superintendent Leo Frank, just minutes after 12 o’clock noon.She asked if the brass had come in so she could return to work on Monday. Frank stated he said no.Later that evening, Phagan would be found dead in the basement of the factory. She had apparently put up a fight, was beaten, strangled, and dragged about with coal dust making her look black, at first. Close to the body were two notes with bad spelling. It was originally believed that Phagan had tried to identify her killer, called a “ night wich,” and “long, tall negro black.”Newt Lee was the tall negro night watchman that discovered Phagan’s body while making rounds and attempted to phone Frank, who didn’t answer. Lee then called the police. Lee became the first murder suspect based on the notes. Lee didn’t know how to read.Frank had called Jim Conley, a black sweeper for the National Pencil Company, to work that Saturday, a day off from his usual work; it was Confederate Day, a State holiday. He was interviewed by the police after someone reported he was washing a red substance from his clothes. He stated it was rust, not blood. At the police station, under constant grilling, Conley would tell officers, among other things, that he didn’t know how to write. The police suspected the two notes were possibly written not by Phagan, but by someone else to frame Newt Lee.Eventually, night watchman Lee was eliminated as a subject. Superintendent Frank was a possible suspect based on the fact that he had been reportedly been the last person to see Phagan alive. Frank’s overly nervous behavior had police believing he had something to hide. The authorities inspected Frank’s body for cuts or bruises, plus the suit he wore that day, for any tell tale signs that would connect him with Phagan’s murder. His clothes had neither blood nor soot on them, which was suspicious since the basement was a very dirty place.Frank was questioned if he had written the two poorly written notes, since the police didn’t believe Phagan had. Conley had stated Frank had written these notes.Frank countered and said Conley wrote the notes. Then Frank provided evidence of written invoices that Conley had written for the pencil factory.Based on this, Conley being able to write, the authorities believed the negro sweeper was the murderer who tried to frame Newt Lee, the night watchman.The police once again confronted Conley, stating he could go to prison for perjury. “What is perjury?”, Conley asked. Then Conley surprised everyone by confessing that he wrote the two notes — but that Frank had told him what to write.Could a black man conceive of such a plan, the detectives asked themselves? Jim Conley stated he was only an accomplice who helped to dispose of the body.Mary Phagan’s time of arrival at the factory had been confirmed as just minutes after 12 noon by a boyfriend that had accompanied her to the factory and went on without her to the Confederate Day activities. This was also confirmed by Frank himself. Until this time, Frank had maintained that he had never left his office that afternoon.Enter the testimony of Monteen Stove. She proved to be a crucial witness claiming that she too had showed up for her pay check, to find Frank out of his office, just a minute or two after Phagan’s arrival. She stated she waited from 12:05 to 12:10 PM before finally leaving.Frank now nervously admitted that he might have used the bathroom at that time without remembering. He also tried to revise the time of Phagan’s arrival, pushing it back ten or fifteen minutes.Conley now became the chief prosecution witness who originally stated Frank had told him what to write on the two notes that mentioned a black watchman, found by Phagan. Conley stated the notes were written before Phagan had been harmed, but the police didn’t buy this premeditation story. The police had Conley rewrite the notes that they dictated, which ended up with the same style and misspelled words, including ‘night wich’ for night watchman.The press played up Frank using his money to buy a not-guilty verdict. Many witnesses were brought before the jury saying Frank flirted with the women workers, with one claiming she had been propositioned.But Conley kept intertwining himself with Frank. Conley had all those in the courthouse listening as he described Frank having had sex with Phagan and hurt her, causing her to bleed. Phagan had suffered a severe right black eye and the back of her head was injured. The metal room was on the second floor, same as Frank’s office, and one had to pass through this room to use the bathroom facilities. On the drill press, called a lathe back then, hair similar to Phagan’s was found hanging, along with blood on the floor.Conley stated that the two men took the body down to the basement using the elevator.The prosecutor then scored major points against Frank when he pointed out that the notes had used proper grammar, using the correct words “did” instead of the negro word substitution “done.” This was the difference between an educated man and an illiterate negro. It would be proven later, after going over hundreds of Conley’s written words prior to the murder, that Conley always used “did,” and not “done.”Frank’s being Jewish worked against him in the Deep South state of Georgia in 1915. The all-white male jury found Frank guilty and he was sentenced to death. The trial had attracted national attention, along with that of Georgia Governor Slaton, who would end his term four days after Franks was scheduled to be hanged. Slaton had also agreed to merge his law firm with the Chief Defense lawyer for Frank, Luther Rosser.The legal review board had upheld the hanging sentence 2–1, with the dissenter saying it wasn’t right that the accomplice wasn’t being hung, as he was more likely guilty than Frank.Governor Slaton said he would review the case, which deeply upset the citizens of the state. Slaton viewed over 10,000 pages of documents, and then shocked the populace by commuting Frank’s sentence to life in prison. This act of usurping Southern justice would have fatal consequences for Leo Frank.Men calling themselves the Knights of Mary Phagan drove to the state prison, tied up the warden, drained the police cars of gas, and abducted Frank. Among them them sheriffs, an ex-Governor, a car mechanic, an electrician and many other leaders of the community. Frank was driven back to Marietta and lynched. One person stomped Frank’s face after the hanging, while others tore pieces of Frank’s shirt for souvenirs.His body was taken to an Atlanta funeral parlor, where the proprietor had to open up his establishment for viewing when people threatened to throw bricks. 1,000’s of onlookers passed by to view the body of Leo Frank.In November, 1915, William Simmons would burn a cross atop Stone Mountain, reviving the Ku Klux Klan.Modern historians and criminologists are in near universal agreement that Jim Conley was the murderer of Mary Phagan. Part of this is based on a clue Governor Slaton had received about intact human excrement being reported at the bottom of the elevator shaft. Conley stated that elevator didn’t go all the way to the ground (which would have smashed the feces). However, testing showed that the elevator always hit the ground, so the elevator was not used in Mary Phagan’s killing.In 1982, Alonzo Mann, who in 1912 was a 14 year old white office boy for Leo Frank, wrote in an affidavit that he had seen Jim Conley carrying the limp body of Mary Phagan after he returned to the pencil factory shortly after 12 PM. Conley told the boy he would kill him and his family if he talked. Mann wrote that he told his parents, who told their son to keep quiet.In 1913, Alonzo Mann had testified he had left the factory at 11:30 AM, before Phagan came to the factory.Based on Mann’s statement, Frank received a Georgia pardon posthumously, based on the fact he had been kidnapped from prison and murdered, not that he was innocent of Phagan’s death.The truth of a white boy not reporting a threat by a negro in 1913, has some questioning the honesty of Mann’s 1982 affidavit.LATE EDITION: A few have responded that the validity of Leo Frank fails to meet the criteria of the original question.This was not a simple trial. It had racial and bias religious issues. It was much more than mob justice, or another Southern lynching.Leo Frank, besides being a Jew, was seen as a wealthy, educated Northerner. The trial garnered national interest, with Southern justice being called into question up North. Jewish organizations raised close to a quarter of a million dollars, an astronomical amount in 1915. When the New York Times sent investigators to pore over the transcripts and interview witnesses, Southerners took this as an offense of Yankee interference.That no one was held responsible for the prison raid and lynching of Leo Frank shocked the rest of the Nation. The KKK was reborn directly out of this incident to carry out “Southern Justice.” So was the Anti-Defamation League created, to protect Jews against bias, bigotry, and injustice.As a final note, many of the women and girls that testified against Leo Frank at trial stated in affidavits afterwards that they had committed perjury. These affidavits didn’t help in Frank’s appeals.
