There are several articles and blogs that explains how to register a trademark in India in one way or the other but I hope that this post will be comprehensive enough to answer most of them.A trademark is anyword (PEPSI, COCO COLA, PEPSODENT),name (RAYMOND VEIL, CHRISTIAN LOUBOUTIN),surname (TATA, BATA, BAJAJ),signature (LOUIS PHILIPPE),letters (BMW, IBM, HDFC),numeral (555, 501),symbol (MERCEDES BENZ THREE POINTED STAR, ADDIDAS PYRAMID),device (AMUL GIRL, PILLSBURY BOY),color scheme (PIZZA HUT, DOMINOS),packaging (CADBURY’S),shape of goods (COCO COLA BOTTLE)or any combination thereof that identifies and distinguishes the source of the goods of one party from those of others.When the mark is used in respect of services then the mark is also commonly referred to as Service Mark. File an application with the trademark office.Congratulations! You have cleared the first two hurdles. Give yourself a pat on the back for discovering that you are going to have exclusive rights on your trademark, and proceed with filing a trademark application. You can either file a paper application with the Indian Trademark Office (TMO) or file an application online at http://ipindia.nic.in. So it is important that you file a response with the trademark office within the deadline of 30 days.The objections under absolute grounds are that– your trademark is not distinctive; i.e.: your trademark is not capable of distinguishing the goods and or services of one person from those of others.– your trademark is descriptive or devoid of any distinctive character; i.e.: your trademark directly refers to the goods or services for which the protection is sought. Submission of documentary evidence of extensive usage of your trademark will also help you to strengthen your case.c. Hearing before the examiner.In about six months from filing your response to the examination report, the trademark office will either allow the application to be published in the upcoming trademarks journal for a third party to raise objections to the registration or fix a hearing by sending you a hearing notice with a date and time to meet the examiner and explain why your trademark should be allowed to proceed towards registration. This opportunity should be exploited to explain to the examiner, the evidences filed at the time of responding to the examination report in detail and to submit additional evidence. Subsequently the examiner will pass an order either allowing or refusing registration of your application. If it is a refusal, you can appeal against the order of the examiner before the Intellectual Property Appellate Board (IPAB) with 15 days of such refusal.d. Publication of the application in the trademarks journal.Within two to three weeks from the date of the examiner’s order to publish the trademark, the trademark application is published in the trademarks journal. You can download the trademark journal and check if your mark has been advertised. After the expiry of four months from the date of publication of the trademarks journal in which your mark was published, check the status of your trademark application online and if there are no objections to your trademark by way of oppositions filed by any other person, write a follow up letter to the trademark office requesting registration of your trademark and issuance of your trademark registration certificate.In the event of any person raising an objection to your trademark application by way of an opposition, the trademark office will notify you of the objection along with the copy of the notice of opposition as filed by the other party. Opposition proceedings are complicated and we suggest that you consult your legal counsel.e. Registration of your trademark and issuance of the registration certificate.If no objections are received by way of oppositions to your trademark application within this four month period, the trademark office will grant registration to your trademark and issue the registration certificate. Does “helped me create” mean he/she actually wrote anything that’s being used (verbatim), or did he/she just help you brainstorm or organize your thoughts, or something else?There’s an enormous range of possibility here, not all of which falls into the realm of copyright ownership on his/her part.And then there’s this person’s understanding of the arrangement. Was it friendly help or done in a business manner? Did any compensation occur, monetarily or otherwise? Did you connect with this person through a freelancer platform? How do you know this person aside from this project? Is there a history between you of writing/editorial help one way or another, for pay or not?I suspect you know the answer to your situation, but it’s inconvenient in some way. Otherwise, I’m not sure why you’d be asking. Why not just clarify with this person instead of asking us? This tells me you actually know what the informal agreement was, but for some reason it’s in your way or inconvenient now, and thus you don’t want to bring this to the person’s attention.There’s an old adage that may apply here: We’re never confused; we’re just afraid of something and don’t want to admit it to ourselves.The bottom line is, ethically, you have no choice except to clear things up with him/her. I mean, you could just proceed, play ignorant, and hope nothing comes of it. But that’s both unethical and risky. Far better to just get this straightened out now, formally and in writing. It doesn’t have to be complicated… a simple email is probably enough, or possibly a one-page “agreement of understanding” to be more formal. (I’m not an attorney, however, so take that as worth what you paid me.)Incidentally, I’m not saying you’re being devious — it might’ve started as a casual project that unexpectedly developed into something more serious. That can happen. If this is the case, then one way to proceed is to simply ask (in writing… email is fine) what this person’s understanding of your arrangement is. They can be critical if they want to, but the only thing that I have against them really is that instead of going to the press or their attorneys, I would have preferred that they just talk to me. I was there and I wanted to talk to them, but I did not feel like they were not interested in talking to me. I think we would have had a better understanding of one another if we would have talked face to face and we might have come to some interesting understanding and conclusions. I am not their enemy, and I don’t want them to feel like I am their enemy. That doesn’t make to me any sense. That is what really bothered me when I saw the reports that they were upset with me. I am a survivor, they are survivors, and I think we should have a little more of an opportunity to discuss these issues face to face. There is always a merit to talking face to face, just like I talked to Oskar Groening face to face – there is something happening there. I think the same thing can happen with survivors who might be different from one another and who want to discuss issues. So that is to me the sad part. Should I become the enemy of survivors, or they become my enemy? That is absurd. We should have the same goals in life. Maybe we don’t think the same way but even then, it can be discussed. I think we have a lot more in common than we don’t. One thing people are criticizing me about is because they said I went on a talk show in Germany and called for the prosecution to end. I have never, ever asked for the prosecution to end. On the contrary – I even told Mr. Groening to encourage all the other Nazis to come forward because we need their help now to fight the neo-Nazis. What I was saying and still will say is that I see no merit for a 93-year-old guy to go to jail. They are not going to live that long in jail, and they are already limited in their mobility. But if they can do something as a community service as part of their punishment, I think it would help Germany and it might even help the survivors realize that we need the help of the perpetrators to document that it happened in the eyes of the neo-Nazis and revisionists. So it is not a question of if they should be put on trial, it is a question of what happens to them once they are there. They can be found guilty and as part of their judgment, they could do community service by speaking to people about the truth of the past. That would be more helpful to the survivors, to Germany, and to the people who want to fight neo-Nazis. I always ask, “What is the purpose for what we are doing?” If the purpose is to punish, that is not enough. It does not work, and it doesn’t do anything good. Bearing witness to what happened has a lot more value than putting them in jail. And on the other hand, putting them in jail does not do anything to help the victims feel better, and we are not really trying to help the victims heal their pain. What they are saying to me – and I think the whole assumption is incorrect – is that by putting the perpetrator in jail, we are helping the victims. I would like someone to demonstrate to me how exactly that helps me or other survivors. I didn’t say they should get away with it, but the attention is given to the perpetrators and not the survivors, and that to me is what is wrong. The other major reason they criticize me is because I forgave the Nazis. Why do they think I forgave? Because I wanted to create headlines? Or was it because I somehow stumbled on an idea that helped me better cope with what happened in the past and it liberated me? That is an issue that would be worthwhile for them to discuss with me. I don’t think they understand it. From what I have heard, some survivors say, “Okay, so you forgive, why didn’t you just do it in the privacy of your own home – why do you make it public?” That was their complaint. And I think that merits discussion – why did I make it public? How did it happen? Number one, I want them to understand how it happened. I would like for the survivors – all the survivors – to know that the reason I went to Auschwitz with the former Nazi Dr. Munch in 1995 was not to read to him my letter of forgiveness, but to have him document the existence of the gas chambers. I succeeded in meeting with a Nazi and he was willing to document the operation of the gas chambers. The forgiveness letter came as a result of that, but they skip over that like it never happened. It did happen. It was an important thing to have a Nazi document the gas chambers. So this is what I really wish the survivors would take to heart – because I was willing to meet with a former Nazi, we have a document testifying to the existence of the gas chambers, signed by a Nazi. That is the sort of thing that can happen when you are willing to meet the "other side" with humanity, and that is why I went up to Oskar Groening to shake his hand. I wanted to see what would happen, and what good might result from it. Number two, why do I make my forgiveness public? I felt when I discovered forgiveness like I had found a cure for cancer. It was that amazing to me. If we consider anger and hatred the cancer of the human soul, and if I found a cure for that cancer and it made me feel good and did not hurt anybody, should I keep it secret or should I share it with the rest of the world? It was not like I invented a drug to sell. I was not benefiting from it financially – it was strictly done to help other people. It is not a profit-making thing for me. Just last week I was in a school and a student came up to me. She was beaten by her parents and was crying and didn’t know what else to do. Isn’t it heart-wrenching to see these young people suffer? She had big eyes and they were so sad. They pulled at my heart, I don’t know why. I told her she can be in touch with me and I will help her work through it. I told her I hated my mother and father for a long time. Why? You have to understand how kids think. I thought, Oh I survived, so how come these big grown-ups that I admire didn’t survive? What’s wrong with them? Now they left me an orphan, I don’t belong anywhere, nobody really loves me, nobody really cares if I have food or clothes on my back, and I have to worry about all that. Not an easy thing for a young child. I felt in some way betrayed. Of course in this case I also felt guilty when I was angry with them because they died – they couldn’t help it. But the analysis that goes on in children’s minds, I am very well aware of it. Would this girl have found someone to help her if I did not talk about my experience publicly? So there is a need to talk publicly about forgiveness and healing, and I believe there is a need in the Jewish community too. At the same lecture, a woman told me her father was a survivor but she doesn’t know anything about it because he never would tell her about his experience, and she was very sad. She needs to forgive her father for never talking about it, because she feels that she was left out and she didn’t get any information. These stories come from so many directions that for people to say that I am doing it to get publicity – it’s ridiculous. I am not trying to publicize me, but I am trying to publicize the idea that we don’t have to remain victims, and there is something that each one of us can do to heal our own pain. And by healing our own pain, we are actually helping heal the cancer that is eating the inside of many people’s hearts and souls. So before other survivors criticize me publicly, I wish they would talk to me to see if they can understand me, and to see what I am doing in my educational efforts.

What did you learn in the military that has been useful for your civilian life?
the army taught me many things, both intended, and often times unintentional.Sometimes ranks get in the way of work. A major who is a slave driver may not be able to get his subordinates to accomplish an intended task. Even sabotaging can happen. Thing is, rank reflects nothing except perhaps your duration in the armed forces which can imply many things. The best way to lead people to do things is to do it with them.Don’t ever ask someone to do something you aren’t ready to do it yourself. You’ll lose their respect. Your reputation takes a hit, and before you know it, people cast doubts on your decisions. They start second guessing you.Nobody goes to work to fail. Norman Schwarzwkopf said that. Some times its bad job match. Some times soldiers have other pressing personal matters bothering them. Realistically you can’t solve everything. But if you try, they know you have their backs and will fight for you.How much are you willing to sacrifice? If a friend messes up, protecting him and keeping quiet can be costly for others.Controlled aggression. There is a degree of programming done to soldiers. You don’t want a soldier who is always aggressive, he won’t be able to think straight. Its conditioning, where you can flick on the aggression when called for and switch it off for rationality. Its a great thing to have. You can pick that up from martial arts.Mental conditioning. The army training produced men who don't flinch in danger. Right out of army, I was in a cab that got into an accident. Didn't flinch. Didn't blink. Was plenty annoyed that I was going to be late for the movie. You become a little numb to danger.After a sprint, you’d find it hard to breathe. Its common for many to breathe as hard or as fast as they can. Fight that urge. Instead, hold your breathe. You won’t die. But it triggers a response in the body to slow down the heart rate from its frantic pace. After 10 seconds, take slow deep breaths. Fight the urge to indulge in rapid breathing.Everyone can have different objectives, everyone different roles, but no matter what, everyone must have the same goal to fight for, otherwise the fight falls apart pretty quickly.Every soldier thinks the other soldier knows what he is doing. Often, both are as clueless as goats.Make a decision. A bad one if you have to. But you must never ever be without a decision. Your team can forgive you for bad decisions. Some times bad decisions can be backtracked. Indecisiveness however is unforgivable (I’m guilty of decision paralysis myself).Rolling in the mud, keeps mosquitoes away from you. But it also means the camouflage uniform will be a single brown or orange shape (depending on the mud type) and this shows up against plants.Amatuers debate tactics. Professionals discuss logistics. The groundwork requires more emphasis than the actual fight.The smartest people aren’t always the best soldiers. Maybe it’s better to put them somewhere safer where they can think up solutions without getting us killed.The combat knife is overrated, but you’d never ever find me without one. They are useful as grounding pins incase you enter an area prone to lightning. They also split wood and can be used to dig (I’m serious).If you want to move a battalion to fight a battle, you are moving men and material, not just weapons to a fight. People think it is merely a case of putting people on lorries and moving them there. There will be a lot of loose ends to tie up. People and vital equipment get left behind often. If that happens, you’d end up with a half-functioning battalion arriving in chaos. My point is, the tiniest little things we overlook like personnel registry, which platoon goes into which lorry, or which equipment must be towed by which vehicle, everything must be written down in paper form. Paperwork is dreadful but necessary. Because if you don’t bring a fully functioning battalion against me, and I bring my fully functioning one with all personnel and equipment accounted for, chances are I will win. I cannot emphasise again how the tiny important details matter so very much.Never ever, leave people behind. We spent 2 days looking for a person we assumed was lost in the jungle. Turns out we left him back in the bunk because of a personnel accounting error. The whole purpose of it is to drum into each other that no matter what we will never give up on you. It breeds trust. Like family.Battles are like mathematics. Assume unit 1 is strong, 2 mediocre, and 3 weak. If the enemy arranges their units as 1-2-3, should you meet them as 1–2–3 as well? No, meet them as 3-1-2. Present your weak one to their strong. The weaker unit will suffer. Thus their job is not to fight but to merely hold on to survival. Use your strong unit to overcome their mediocre ones. Use your mediocre unit to overcome their weak ones. Soon, you will outnumber the opponent.Never ever underestimate an enemy. We had a battalion training exercise where three of us (elite recce troopers and I was the accompanying signaller) on a ridgeline harassed a platoon (27 of them) on the move and kept them from their objectives for an hour. After a while they sent the entire company against us only to discover that they were fighting only 3 guys. They thought we were a platoon sized enemy on a flanking maneuver. Against overwhelming odds, always try to fight in an environment that is hostile or difficult to your opponent (they had to climb the ridge and circle it to get to us). If it isn’t, then move until you are in a much better position or realm.Weight. I know its common to see US soldiers carrying so much stuff on their body. The amount of gear they wear. The excessive amount of nylon their webbing has. Their MRE packs amaze me, because I call that unneccessary weight. The US army is largely vehicle bound. I’d shed a lot of stuff and carry the bare minimal because in our army, we aren’t as vehicle bound. Its common to hear that we need to tab 20–30km for a single mission in the forest/jungle where no vehicles can enter. I learned that perhaps the bare minimal makes for faster movement.The more equipment you have, the more logistics you’d require to support or move that equipment. And those logistical teams doing those work? Even they too need logistics to support their work, and it goes on. Every important task needs people, but these people need to be provided for to accomplish their task. And the supporting crew themselves need to be provided for all the way back to the beginning of the logistics chain. This creates a long logistical headache. Thus to thin down the personnel needed for logistics and move them to the frontline, reduce the amount and variety of equipment. Bring ONLY those you absolutely need. Anything else is just waste.Items for trading. Always carry things that others will need, to trade, gain favours, or make friends. I don’t smoke, but I carry cigarattes, and a jar of peanut butter.Into the fight. Know that you are always superior in many ways. No matter how the enemy is stacked against you, know that you have some advantage they don’t. The larger they are the slower they move or pivot. But have the sense that you have your limitations.Always try to win. Don’t ever let the other fucker win. Remember that you are superior always.
